RESOLUTION REMANDING TO THE PLANNING COMMISSION
DECISION OF PLANNING COMMISSION DENYING ARCHITECTURE AND SITE
APPLICATION AND CONDITIONAL USE PERMIT APPLICATION TO CONSTRUCT
A 7 -UNIT RESIDENTIAL CONDOMINIUM PROJECT IN THE RM:5 -12 ZONE
(16935 ROBERTS ROAD - BAS HOMES, INC.}
WHEREAS:
A. Stephen R, Stern, President of BAS Homes, Inc., on behalf of the
appellant, has appealed a decision of the Planning Commission as follows;
denial of Architecture and Site Application S -85 -68 and Conditional Use Permit
Application U -85 -30 requesting approval to construct a 7 -unit residential
condominium project in the RM :5 -12 zone on property located at 16935 Roberts
Road owned by American Bank and Trust; and
B. A public hearing was set for March 16, 1987 and continued to and held
on April 6, 1987;
IT IS HEREBY RESOLVED:
A. The Town Council hereby finds that seven units is too dense for the
project given the traffic impact and safety concerns for pedestrians in the
area of the project,
B, The Town Council hereby remands the appeal to the Planning Commission
with review by the Development Review Committee to consider a less dense
project if the applicant desires to submit same, Such consideration shall be
made without additional application fees,

PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of
Los Gatos, California, held on the 20th day of April ,1987 by
the following vote.
