A RESOLUTION APPROVING THE ANNEXATION
OF CERTAIN UNINHABITED TERRITORY
DESIGNATED AS TOP OF THE HILL #2
TO THE TOWN OF LOS GATOS
RESOLVED, by the Town Council of the Town of Los Gatos, County of Santa Clara,
State of Los Gatos, County of Santa Clara, State of California that
WHEREAS, the proposed annexation to the Town of Los Gatos consisting of all that
unincorporated territory designated as TOP OF THE HILL #2 Annexation, located at
15301 TOP OF THE HILL ROAD in the County of Santa Clara is proposed for annexation
to the Town of Los Gatos pursuant to Part 2 of Title 4, Division 3, commencing with
Section 56000 et seq. of the Government Code;
WHEREAS, the Town of Los Gatos has received a petition signed by all the owners
of land within the territory to be annexed, and pursuant to Section 56837 of the
Government Code, the Town Council of the Town of Los Gatos may initiate proceedings
to annex said territory without notice, hearing or election, in the manner described
in Section 57002 of the Government Code of the State of California, and make the
following findings:
1. The project is categorically exempt from CEQA Class #15119(a).
2. The territory is "Uninhabited" as defined in Section 56046 of the
Government Code of the State of California; and
WHEREAS, the Town Council finds that these findings are correct, and the
territory proposed for annexation is situated in the unincorporated area of the
County of Santa Clara, and is contiguous with the municipal boundaries of the Town
of Los Gatos.
RESOLVED, by the Town Council of the Town of Los Gatos, a municipal corporation
of the County of Santa Clara, State of California, that pursuant to the provisions
of Sections 56837, 57022, and 57002 of the Government Code of the State of
California, the annexation to the Town of Los Gatos of that territory designated as
TOP OF THE HILL #2, and described in real property description and map attached
hereto, marked Exhibits "A" and "B ", respectively, is approved, and that the same be
annexed to the town of Los Gatos.
FURTHER RESOLVED, that upon completion of these annexation proceedings the
territory annexed will be taxed in Town of Los Gatos Tax Rate A, including taxes for
existing bonded indebtedness.
FINALLY RESOLVED, that the Town Clerk is authorized, and is hereby directed,
pursuant to Section 57200 of the Government Code, to prepare under seal a certified
copy of this resolution, giving the date of passage, and immediately transmit same
along with a remittance to cover the fees required by Section 54902.5 of the
Government Code to the Executive Officer of the Local Agency Formation Commission of
Santa Clara County.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos held on 16th day of March , 1987 by the following vote:

Description
All that certain real property situate in the County of Santa Clara, State of
California, described as follows:
Beginning at the Northwest corner of that certain Parcel 2 of the Parcel
Map of the Lands of Cusick, recorded March 18, 1980, Book 460 of Maps, Page
34, Santa Clara County Records, said point of beginning lying on the
Easterly line of that certain annexation to the Town of Los Gatos known as
Shannon Road No. 13 (240); thence running along said annexation line South
07 35' 00" East 315.83 feet; thence leaving said Shannon Road #,13
Annexation (240) North 87° 58' 30" East 336.84 feet, said line being the
Northern line of that certain annexation to the Town of Los Gatos known as
Top of the Hill Road #3 (267); thence continuing along said Top of the Hill
#3 Annexation (267) South 0° 18' 12" West 158.97 feet; thence leaving said
Top of the Hill Road #3 Annexation (267) North 87" 58' 30" East 118.04
feet, said line being the Northern line of that certain annexation to the
Town of Los Gatos known as Top of the Hill Road #5 (268); thence leaving
said Top of the Hill Road #5 Annexation (268); North 1° 59' 23" West 200.81
feet to a point on the Southerly right -of -way line of Top of the Hill Road;
thence running along said right -of -way line on a curve to the right with a
radius of 105.00 feet through a central angle of 28° 46' 30" for a distance
of 52.73 feet; thence continuing along said right -of -way line North 63` 15'
West 130.58 feet; thence continuing along said right -of -way line on a curve
to the left with a radius of 370.00 feet through a central angle of 4° 36'
00" for a distance of 29.92 feet; thence continuing along said right -of -way
line North 67° 53' 00" West 166.58 feet; thence continuing along said
right -of -way line through a curve to the right with a radius of 105.00
feet, through a central angle of 420 35' 38" for a distance of 78.06 feet;
thence continuing along said right -of -way line North 25` 17' 22" West 51.35
feet; thence continuing along said right -of -way line on a curve to the left
with a radius of 45.00 feet through a central angle of 22" 59' 07" for a
distance of 18.05 feet to the point of beginning.
