Environmental Impact Report EIR -85 -1A b. Zone Change Application Z -86 -6 Requesting a change in zone from 0, R- 1:8000 and RM:5 -20 to RM:5 -20 -PD in order to construct a 75 unit residential development on property at the southeast corner of Blossom Hill Road and Roberts Road. OWNER /APPLICANT: Ed Nino and Will Crosby 2. The CONSULTANT is willing to perform such professional services upon the terms and conditions herein set forth: THE PARTIES DO HEREBY AGREE AS FOLLOWS: SERVICES 1. CONSULTANT shall perform those professional services described in the "Scope of Services" attached as "ATTACHMENT A." CONSULTANT'S work products and schedule of delivery shall be in accordance with the "Work Products and Schedule" attached as "ATTACHMENT B." Scheduling will depend on factors beyond (but not limited to) prompt submittal of weather conditions, delay caused by alte etc. CONSULTANT will diligently perform the schedule outlined above but will not his control. COMPENSATION CONSULTANT'S control including required data by the TOWN, adverse ^ation in the scope of the project, the required services according to be responsible for delays beyond 2. Compensation for CONSULTANT'S professional services shall be at a firm fixed price of $17,762.50; payment to be made in accordance with Work Products and Schedule stated in ATTACHMENT B. The following is the schedule of payments by the Town for work completed. a. Receipt of signed copies of contract. Payment for 25 percent of the contract value. b. Delivery of eight copies of the administrative draft EIR. Payment for 50 percent of the contract value. c. Delivery of 65 copies of the draft EIR. Payment for 10 percent of the contract value. d. Delivery of 65 copies of Response to Comments. Payment due for 15 percent of the contract value. STANDARDS 3. CONSULTANT'S work shall be performed in compliance with the requirements of the Environmental Quality Act of 1970, as amended (Public Resources Code Section 21,000 to 21,176, inclusive), and the Guidelines for Implementation of the California Environmental Quality Act of 1970 originally certified and adopted by the Secretary of the California Resources Agency as Administrative Regulations on February 3, 1973, and as thereafter amended, if applicable. OF SERVICES A. Project Description The EIR will describe the project based on changes that were made after the EIR was published. As currently proposed, the project would have 75 dwelling units including single family residences, townhouses and BMP condo- miniums. The site plan has been changed to decrease density and to maintain through — traffic on Robert's Road. The applicant maintains that he has a commitment from the County Park District to relocate the entrance to Vasona Park so that it is opposite the Blossom Hill entrance to the site. A traffic signal would be installed at the new intersection. Access to the upper section of -the site would be via a road placed about 120 feet from the new intersection, across a 15% grade. This means of access could create hazardous conditions, which will be addressed in the EIR. Other characteristics of the project should be defined by the applicant in sufficient detail so that the project may be evaluated for environmental review purposes. This includes the amount and location of parking spaces, open spaces, grading and drainage plans, tree removal, a geological soils report, and building characteristics. PAD will obtain from the applicant a clear and concise statement of the reasons for undertaking the project, including the need for the project, the target market, and the reasons for selecting this particular site. The EIR will note the applicant's schedule and costs for the project. This section of the EIR will present the sequence of approvals required for the project, including environmental clearance, rezoning and a permit for street closure, if applicable. This section of the Subsequent EIR will provide an historical review of proposals for the site. There will be a summary comparison of the currently proposed project with the previously proposed plan for 173 units. The summary will highlight differences in significant impacts in degree and kind. Mitigations from the previous EIR that are included in the current plan will be noted along with any additional mitigations that might be needed. ATTAQ-1IENT 4 3 B. Issues Found not to be Significant In the EIR there will be a statement of why certain issues are found to be Insignificant and are focused out of the EIR. It appears that the following issues can tentatively be focused out. • Air Quality • Seismicity • Archaeology and Cultural Resources The EIR will describe the air quality at the Los Gatos air quality monitoring station using the most recent data available from the Air Quality District. Los Gatos has good air quality, and project traffic is not expected to result in measureable changes in pollution levels. Therefore, this topic does not require further study. A preliminary soils report should be available during the environmental review process. If this done early on, soils, geology and seismicity could be focused out of the EIR. Archaeology and historic resources can be focused out of the EIR. An archaeological records search and site reconnaissance revealed that there are no known archaeological resources on the site. The Nino House will'be retained, so no significant impacts on the cultural resource will occur. C. Potentially Significant Impacts The EIR will also state which impacts will be essentially unchanged under the currently proposed plan. Tentatively, this includes: • Hydrology -- • Energy • Growth— Inducement Potentially significant impacts that would change Under the current plan are expected for the following topics: • Land Use and Housing • Traffic, Access and Circulation • Noise • Visual Quality 4 • Biotic Resourc • Geology & Hydrology • Construction These topics are the focus of this EIR. The EIR will describe the environmental setting, impacts and mitigation measures for topics that could have a potentially significant impact on the environment. There will be a table that summarizes impacts and mitigations for easy reference, and mitigations will be expressed in language similar to conditions of approval, identifying responsibility. Each of these topics is discussed below. fly . . Environmental Setting The "setting" section of the Subsequent EIR will be the same as for the previous EIR: It will describe the site as it relates to surrounding uses including residences, Vasona Park, the local and regional circulation system, and the natural environment. Important natural features are Los Gatos Creek, the park, the mountains and terrain of the site itself. The setting of the project will be described in terms of the existing land uses characterized by: • green open space including an old orchard and mature trees; • residential buildings and other structures on the site; • surrounding= residential, commercial, circulation and open space uses; • the hillside terrain and backdrop of mountains; • hazardous intersections; • Los Gatos Creek; • condition of Robert's Road bridge. This section of the EIR will describe Town policies that relate to the land use proposed for this site, including: • The General Plan designation for the site as High Density Residential which permits 5 — 20 units per acre; • The suitability of the site, as vacant land, to be used for housing; 5 • The zoning designation for the site which is predominantly R -1:8 (Single Family Residential with an 8000 sq. ft. minimum lot size) with some Office and some RM 5 -20; • Housing Element policy which calls for all development in excess of 20 units to provide 20% below market rate housing; • Planned Development (PD) zoning designation that permits the 20 —unit per acre density proposed by the applicant; • The Housing Element of the General Plan which notes that Los Gatos has maintained a larger share of elderly residents than the county as a whole; • The Town's ABAG housing allocation which identifies a need for 972 dwelling units. • The Housing Assistance Plan which states that those most in need of housing are the elderly; • Housing Element policy which states that elderly housing is eligible for a density bonus for up to 100% of the permitted units; • The Capital Improvement Program which calls for a variety of improve- ments to Blossom Hill Road and its intersections. Land Use Impacts This section of the previous EIR will be completely revised. The primary land use impacts of the project will be described in this section of the EIR, Including the following: • Density; • Compliance with General Plan and other development policies; • Compatibility of the project with surrounding land uses; • Density, scale and transition to residential, commercial and open space areas, particularly Vasona Park; 3 • Relationship t lousing needs in the Town; • Loss of open space; • Access and linkages to other parts of the Town. Land Use Mitigations For each impact identified above, mitigation measures will be identified. These will include mitigations that are already included in the project (such as provision of below market rate housing) as well as measures identified in the previous EIR. Environmental Setting This "setting" section will be the same as in the previous EIR. The Housing Element identifies the Town's housing need for 972 dwelling units, with an emphasis on elderly and low and moderate income family housing. Housing programs to address this need are the Below Market Price Units (BMP) program, the Secondary Units program and density bonuses. The density bonus functions under the Special Use designation of the General Plan. This section of the EIR will describe: • The Town's housing need; • The amount of housing recently constructed to meet that need; • The housing programs that apply to the site; • General Plan policies (other than the Housing Element) that affect housing. Housing Impacts The project is required to provide below market rate housing for low and moderate income households in an amount equal to 20% of the. market rate housing, as more than 20 units are proposed. This will be done by providing smaller, less expensive housing than the market rate units. The site is eligible for other density bonuses equal to the number of units that are set aside for the elderly and handicapped. However, the Town has already 7 rejected more dense al` natives for the site. The EIR will address the project's compliance with these Housing Element policies. The housing impact analysis will identify the following: • Amount and proportion of below market rate housing that will be pro- vided; • Whether the BMP housing will be affordable to moderate income house- holds, using the 80 - 120% of median income standard. • Method by which housing subsidies will be funded; • Whether subsidies should /could be deep (low income) or shallow (mod- erate income); • Eligibility for density bonuses; • Developer documentation regarding how project meets the Town's housing needs. Housing Mitigations The need for mitigations will be based on the evaluation of how the project serves the Town's housing need. There is not expected to be adverse environmental impacts that cannot be mitigated by means other than reducing the amount of housing FISM. •1. ,• Environmental Setting This section of the EIR will describe local and county -wide traffic information. It will describe local and county -wide traffic and circulation conditions that affect the site and the Town 'as a whole. Access to the site, sight distances and accident history of the vicinity will be presented. Salient traffic characteristics are the following: • The role of Blossom Hill Road in serving cross - county, as well as local traffic; • The existing level of service (E and F) at intersections along Blossom Hill Road; D • The carrying capacity of the Los Gatos circulation system; • The condition of the Roberts Road bridge; • Capital Improvement Program policies for signalizings widening and otherwise improving the circulation system; • The off -set intersection of Blossom Hill Road, the Vasona Park en- trance and Roberts Road; • Alternative improvement plans and schedule for State Route 85. Traffic Impacts This section of the EIR will be revised to reflect current conditions and the expected impacts due to 75 dwelling units. The scope of work is described below. • Traffic volume data obtained for the Vasona Heights EIR will be used, with a 1.2 percent per year growth factor to cover background growth in traffic not attributable to specific projects. • The street system serving the site will be described in terms of number of lanes, provisions for pedestrians and cyclists, and traffic control devices. This will be done for- - Blossom Hill Road University Avenue - Roberts Road • Traffic Impacts PM Peak Hour Basis. Vehicle trip generation will be reestimated using separate trip generation rates for condos and for single family houses, from CalTrans studies. Traffic will be distributed to the road system in the same manner as for the Vasona Heights EIR. Cumulative traffic impacts will be recalculated using a revised list of approved projects and pending projects furnished by the Town of Los Gatos. • PM peak hour turning movement counts will be made for the intersections of: L - Blossom Hill Road / Roberts Road - University Avenue / Roberts Road - Blossom Hill Road / Los Gatos Boulevard • PM peak hour turn movement counts for University Avenue / Blossom Hill Road and University Avenue / Saratoga Avenue will provided by the Town. • Project trip generation rates will be calculated based on assumptions approved by the Town. • Cumulative impacts will be validated based on list of approved and pending projects with supporting reports supplied by the Town. • Levels of service will be calculated for PM peak hour conditions for the ten intersections that were analyzed for the Vasona Heights EIR, using updated existing traffic counts, the new approved projects list, the new project traffic estimates, and the new pending projects list. Intersections will be analyzed by Circular 212 Planning methods. • Percentage increases of traffic at critical intersections due to the project shown for each of the above LOS .calculations, using method- ology approved by the Town. • Evaluate the realignment of the Blossom Hill Road / Vasona Park / Roberts Road intersection approaches, and potential to use Roberts Road as a short cut; • Evaluate the impacts of relocating Roberts Road; • Evaluate widening or otherwise improving the Roberts Road bridge; • Evaluate left turn impacts, into and out of the site and left turns from Roberts Road to University Avenue if the bridge is widened; and • Evaluate the adequacy of the parking in terms of amount and location. Traffic Mitigations The percentage increase due to project traffic will be shown for all inter- sections analyzed plus Blossom Hill Road at the Highway 17 overpass, using traffic count data from the Vasona Heights EIR or from additional counts 10 furnished by the Town of Los Gatos. Mitigation measures on which the project may be required toparticipate in costs include: ® Signalization of Roberts Road / Blossom Hill Road • Widening of the Blossom Hill Road bridge over Highway 17 • Improvements to the Roberts Road bridge over Los Gatos Creek • Safety improvements for children going to the Fisher Junior High School Intersection improvements at those intersections with a level of service worse than D for which intersection improvements are consi- dered to be feasible by the Town of Los Gatos Engineering Department. The traffic engineers will also describe the role Route 85 will play in relieving traffic near the site. ..• Environmental Setting The noise conditions on and around the site are described in the Expanded Initial Study which was based on recent measurements. This data was recalibrated in the previous EIR to account for changes in the site plan and architectual design which reduced the incidence of traffic noise on the residential units. The current plan appears to be similar to the project analyzed in the Initial Study as far as noise impacts are concerned. Noise Impacts The noise impacts of traffic on the project will be based on the existing 15— minute noise measurements which were taken during park hour traffic times. The previous EIR identified locations were various noise levels would be reached, and recommended appropriate mitigations. These noise levels will be located on the current site plan to determine the need for improvements. It is expected that noise impacts for houses aligned with Blossom Hill Road and Highway 17 will need substantial noise reduction. 11 Noise Mitigation Measures The EIR will recommend ways to reduce the noise level as much as possible to achieve Town noise goals. This will include recommendations to further reduce noise by site planning, architectural design and selection of building materials. 5, Visual 011ality Environmental Setting The "setting" section of the Subsequent EIR will be the same as the previous EIR. The EIR will describe the existing visual setting of the site and surrounding area drawing on some of the discussion of the land use section (compatibility, density, loss of open space). Additional emphasis will be placed on the views as seen from Vasona Park, Route 17, residential neighbor- hoods and Blossom Hill- Road. The visual setting will be presented photographically showing the various land uses with their characteristics, and prominent features of the natural landscape. Near, mid -range and distant views will be photographed and dis- cussed. This section of the EIR will discuss the Community Design Element policies that apply to the site. Visual Impacts A new visual analysis will be prepared for the current site plan. PAD will replicate the "wire frame" graphics in the previous EIR that showed project height and bulk from Blossom Hill Road, Vasona Park and Highway 17. PAD will rely upon the project applicant to provide a site plan on an accurate topographic map, including trees, and to provide the needed manpower to set measuring poles in key locations on the site. This section of the EIR will address the following issues: • The compatibility of building heights, materials, fenestration and other architectural features with natural character of the vicinity; • The visibility of buildings from residential areas, Vasona Park, and thoroughfares; 12 e Site planning techniques to reduce apparent densityp including use of landscaping, setbacks and low buildings fronting Blossom Hill Road, Roberts Road and Route 17; e The effectiveness of landscape screening; e The visual treatment of entrances and parking areas; e The shielding of nighttime light and daytime glare. e The visual impact associated with the loss of green open space; e The significance of removing the mature and other vegetation; e The impact of the project on views of the mountains, especially the ridgeline; e The visual impacts of the project as seen from nearby, mid —range and distant locations, including residential areas, Blossom Hill Road and uphill vantage points; e Preservation of the riparian zone; and e, Visual impacts at the highest elevations. Mitigation Measures For each significant visual impact, the EIR will recommend feasible mitiga- tions to improve the architectural design and site plan of the project. Use of landscape buffers, variation in setback lines and buildings height and use of appropriate nighttime light fixtures are some among the mitigations that will be recommended. Environmental Setting The section of the Subsequent EIR will be the same as the previous EIR. The site is in a somewhat natural state and fits in well with the rural ambience of the Town. It supports many mature trees and is traversed by Los Gatos Creek which supports riparian vegetation. The creek flows into Vasona Lake 13 which supports fish any, other wildlife. Stormwater r_.off enters the creek as part of the natural drainage regime, but much of the precipitation is naturally absorbed by soils and vegetative cover. The Open Space Element encourages retention of stream bed corridors in their natural setting and recommends using them for paths and trails whenever possible. Biotic Impacts The Subsequent EIR will revise the impact assessment of the previous EIR. The current plan would not impact the riparian corridor and would have a less dramatic impact on trees. The previous plan called for the removal of 32 trees, 13 of which are "protected "; this has reportedly been reduced in the current plan. The EIR will identify important trees that will be lost and the amount and type that will be retained, along with an analysis of the effects this will have on erosion, visual quality, and wildlife. The EIR will describe the project's compliance with trails policies of the Open Space Element regarding the bicycle trail that is under construction in the riparian zone and another that is under consideration. Biotic Mitigation Measures The mitigations in the previous EIR will be reviewed with; respect to the current plan, especially regarding protection of mature trees. The project sponsor's responsibility to contribute funds fore trail improvements will be determined. . . ■. .,. Environmental Setting This setting section will be similar to that to the previous EIR, with revisions appropriate to the current site plan. The EIR will describe the main characteristics of the site, including: • The distinct upper and lower areas separated by tree— filled slopes that are very steep in parts. • The existing road on the site that ascends to the top of the hill and was built by making steep cuts into the hillside; 14 • The cut banks Route 17 along the eastern pi -perty line; • A 100 -year flood plain on either side of the creek; • The natural drainage for the site which includes the creek. Environmental Impacts This section of the previous EIR will be substantially revised. The EIR will evaluate the grading impacts of the project, providing a grading plan is made available by the applicant. Potentially significant issues are: • The amount of grading; • The impacts of an on -site road with a 15% gradient; • The treatment of the existing walls; • Cuts and fills along Blossom Hill Road; • Unretained fill, berming, and hill grading; and • Siting four units within 100 -year flood plan. In order to assess the grading impacts of the project, a civil engineering report and grading plan will be required of the applicant along with calculations of the amount of cut and fill and method of dealing with any imbalance. In order to determine the drainage impacts of the project, the following information will be needed from the applicant: • An accurate topographic map; • Amount of impervious surface; • An estimate of runoff increases; and • A description of how runoff will be conveyed and treated. This issue could be focused out of the EIR if information is made available when work is begun on the Subsequent EIR. Mitigation Measures Mitigation measures will address the following issues: • Ways to minimize and balance cuts and fills; • Treatment of runoff to protect water quality; • Construction techniques to minimize erosion; • Revegetation to retain soils; and 15 • Reduction of irr nrvious surface to decrease rur -ff. :f Environmental Setting This section of the previous EIR will be updated. The EIR will describe the public service systems that serve the site, in terms of service area, capacity, limitations on service and the Capital Improvement Plan. The main project affecting the project is the implementation of the Route 85 plan which will dramatically relieve Blossoms Hill Road and other east -west traffic carriers. Other public service systems that may be affected by the project and will be reviewed in the EIR are: • Sewers; • Water Supply; • Drainage; and • Solid Waste Disposal. Public Service Impacts The impacts identified in the previous EIR appear to be relevant to the current project. PAD will review the Draft EIR for the Route 85 project to obtain information on the amount of traffic it will carry, the road that will be relieved of traffic, and how much Los Gatos is likely to benefit. This will be correlated with the traffic mitigation measures for the project, and the time frame in which both projects are likely to occur. Mitigation Measures The EIR will identify the specific responsibilities of the project applicant to mitigate public service impacts, including improvements that must be made on or off the site. This section of the Subsequent EIR will be similar to the previous EIR. The project will have noise, traffic, erosion and air quality impacts during construction. The EIR will estimate the magnitude of the impact as well as its duration. Among the measures that will be presented are: 16 • Tons of dust — nerated over a given period of 61me; • Noise levels .. typical construction equipmen_, • Amount of truck trips per day; • Duration of hauling; and • Duration of site preparation. It is the responsibility of the applicant's engineer to estimate soil loss and impacts on the creek if appropriate precautions are not taken against erosion during construction. It is the responsibility of the applicant to provide background information on truck trips and construction phase duration. Mitigation Measure The EIR will specify mitigations to: • Reduce air -borne dust during site preparation; • Reduce equipment noise during construction; • Reduce disturbance due to truck hauling; and • Reduce soils erosion during and after construction. Environmental Setting This section of the Subsequent EIR will be the same as the previous EIR. CEQA requires that all EIRs address the energy impacts of projects. The Town Energy Element calls for additional energy- saving actions such as use of solar energy and encouragement of energy conscious site planning. The General Plan policies will be reviewed in this section of the EIR to identify those that are germane to the project. Energy Impacts The EIR will address the following energy impacts of the project: • Energy consumption due to transportation; • Energy consumption due to heating and cooling; and • Energy conservation due to site design and solar access. Transportation energy consumption will be derived from estimates of vehicle miles travelled and standard energy consumption rates for different types of vehicles. 17 Heating and cooling enc ,y consumption will be deriver rom Title 24-energy budgets, which should be available from the project applicant. Energy Mitigations PAD will recommend ways in which energy consumption could be reduced, including measures that: • Reduce solar gain and heat loss in buildings; • Encourage greater use of transits; • Require use of solar energy systems; • Improve building construction beyond the requirements of Title 24. Environmental Setting This section will" be the same as in the previous EIR. Growth- Inducing Impact`s While the project is a result of previous growth, it will have growth — inducing impacts of its own. These impacts are due to (1) intensification of land use. (2) increased population in the Town, and (3) increased spending power in the Town attributable to the occupants. If any public services will have to be expanded to increase capacity, this too will have a growth — inducing impact. The EIR will discuss these impacts in terms of land use succession process and the multiplier effect of new expenditures in the Town by project residents. D. Alternatives to the Project The Subsequent EIR will include the "no project" alternative plus the previously proposed plans for 110 and 173 units. is ATTACHMENT Payment Schedule The payment schedule for work completed as described in Attachment A shall be as follows: (1) 25% retainer upon execution of contract. (2) 50% upon submission of the Administrative Draft EIR to the Town. (3) 20% upon submission of the Draft EIR to the Town. (4) 5% upon certification of the Final EIR by the Town Council. The consultant shall bill the Town for services completed based on the above schedule. For any work required by the Town beyond that described in Attachment A, payment shall be made upon completion of the work and receipt of the bill.
