RESOLUTION DENYING ZONE CHANGE APPLICATION
REQUESTING A CHANGE IN ZONE FROM R- 1:8000 TO
R- 1:8000 -PD AND REMANDING TO THE PLANNING
COMMISSION SUBDIVISION APPLICATION REQUESTING
APPROVAL OF THREE LOT SUBDIVISIONS
(15313 Winchester Boulevard - J.L.R. Properties)
WHEREAS:
1. J.L.R. Properties have submitted Zone Change Application
Z -85 -1A to permit a change in zone from R- 1:8000 to R- 1:8000 -PD
and Subdivision Application M- 85 -15A requesting approval of a three lot
subdivision on property located at 15313 Winchester Boulevard;
2. A public hearing was held by the Town Council on August 4,
1986 to consider the Planning Commission recommendation of approval of
the planned development ordinance relating to said applications:
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission
erred as follows:
a. The Council did not direct approval of a planned
development on the property;
b, The Council did not direct three lots but said it
was a maximum for the property; and
C. The Council directed that a wider street as requested by
the neighborhood be included in the project.
2. The Town Council hereby further finds as follows:
a. The property may be developed in accordance with the rules of
the zone without a planned development; and
b. The residents in the neighborhood prefer a wider street which
includes the removal of existing trees.
3. Based on the foregoing findings, the Town Council denies the zone
change application; remands the subdivision application for a tentative map to
the Planning Commission for consideration in compliance with all applicable
Town regulations: and directs that no additional fees are to be paid by the
applicant.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos, California, held on the 2nd day of September
by the following vote.
