RESOLUTION REMANDING TO THE PLANNING COMMISSION
DECISION OF PLANNING COMMISSION DENYING ZONE CHANGE
APPLICATION REQUESTING A CHANGE OF ZONE FROM 0,
R- 1:8000 AND RM:5 -20 TO RM:5 -20 -PD TO CONSTRUCT A
173 UNIT RESIDENTIAL DEVELOPMENT ON 8.8 ACRES
(Southeast corner of Blossom Hill Road and Roberts Road - Pendar Corporation)
WHEREAS:
1. Abe Betpolice, on behalf of applicant Pendar Corporation, has appealed
a decision of the Planning Commission denying of request for Zone Change
Application Z -84 -5 requesting a change of zone from 0, R- 1:8000 and RM:5 -20 -PD
to construct a 173 unit residential development on 8.8 acres of property at
the southeast corner of Blossom Hill Road and Roberts Road owned by Ed Nino
and Will Crosby;
2. A public hearing was held by the Town Council on May 5, 1986.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the applicant proposes modification
to the project as follows:
a. Provide 20% below market price units;
b. Phase development acceptable to Town in line with absorption
rates; and
c. Provide funds for assurance of off -site improvements.
2. The Town Council hereby finds that the Planning Commission erred as
follows:
a. By directing the applicant to submit an alternate proposal for
a higher denisty than the applicant's original proposal; and
b. By not giving the same consideration to the traffic impact as
given to the need for housing.
3. Based on the foregoing findings, the appeal is hereby remanded to
the Planning Commission with review by the Development Review Committee for
consideration of the new proposal or any other proposal of the applicant in
light of the errors set forth above, consideration of all aspects of the
Environmental Impact Report and for consideration of the following:

a. Denisty: The denisty of the project could range from 5 up to and
including 10 dwelling units per acre with 20% BMP included within
the maximum density range:
c. Parking: Overflow parking from Vasona Park is a serious problem
on weekends, project plans should deal with the problem;
d. Off -site improvements: The staff shall make recommendations on
the level of participation and financial contribution for off -site
improvements related to the impact of the project, including but
not limited to:
1. Roberts Road bridge safety improvements;
2. Widening of Blossom Hill Road bridge over Highway 17;
3. Pedestrian improvements for the safety of children going to
Fisher Junior High School;
4. Signal at Blossom Hill Road and Roberts Road (the intersection
adjacent to the project); and
5. Proportionate share of costs for improvements at any other
intersection impacted by the project;
e. Roberts Road:
Reexamine the status of Roberts Road as a public vs. private
street through the project;
2. Eliminate the offset intersection configuration at Blossom
Hill Road and Roberts Road by realigning Roberts Road and
the entrance to Vasona Park to create a typical four legged
intersection; and
3. Oakmeadow Drive is not suitable as an exit for Roberts Road
if Roberts Road is made into a cul -de -sac west of Los Gatos
Creek.
f. Historic Preservation: Preserve the Nino House and the rock wall.
g. Visual impact: The project should be redesigned to eliminate the
adverse visual impact along Blossom Hill Road. Two suggestions:
(1) limit the height of the buildings along Blossom Hill Road to
one story, and (2) eliminate the design elements that cause the
repetitious appearance of the units.

h. Solar Design: The design of all units shall include provisions
for passive solar hearing and cooling to the extent possible.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 19th day of May, 1986, by the following
vote:
