RESOLUTION GRANTING APPEAL OF THE PLANNING COMMISSION
DENIAL OF REQUEST FOR APPROVAL OF CERTIFICATE OF
COMPLIANCE ON TWO LOTS LOCATED IN THE R- 1:20,000 ZONE
(17101 Los Robles Way - Old National Financial Services, Inc.)
WHEREAS:
1. Barbara Johnson, on behalf of Old National Financial Services, Inc.,
has appealed a decision of the Planning Commission as follows: denial of
request for approval of certificate of compliance on two lots located in the
R- 1:20,000 zone on property located at 17101 Los Robles Way (Subdivision
Application M- 79 -17A),
2. A public hearing was held by the Town Council on December 2, 1985,
January 6, 1986, March 17, 1986 and April 21, 1986.
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that circumstances have changed since
the filing of the subdivision application in that a portion of the structure
on Lot 14 no longer straddles the property line with Lot 11 due to removal of
a portion of the structure.
2. The Town Council further finds that the Lot 11 and Lot 14 were
established by a tract map recorded in 1927.
3. The Town Council further finds that a Certificate of Compliance is
mandatory and may be granted subject to conditions pursuant to Government Code
Section 66499.35.
4. Based on the foregoing findings the appeal is hereby granted and a
Certificate of Compliance shall issue subject to the following conditions:
a. A minimum 10 foot wide sanitary sewer easement shall be
dedicated to the satisfaction of the Town Engineer.
b. The applicant shall guarantee by contract and bond, the
installation of the following improvement, to the
satisfaction of the Town Engineer.
c. After connecting to the sewer, the existing septic tank
must be properly abandoned (compacted fill). Leaching
trenches within 10 feet of proposed foundation (Lot 14)
must be excavated and properly filled, to the satisfaction
of the Environmental Health Services Department.
d. The water supply for fire protection must be upgraded to a
minimum of 1000 gpm, to the satisfaction of the Central Fire
Protection District.
e. The sanitary sewer line shall be kept a minimum distance of
72 inches from the trunk of any existing tree.
f. Architecture and site approval shall be required.
g. No building permit shall be issued by the Town until
adequate secondary means of emergency access is provided
to the site, to the satisfaction of the Town Engineer.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Los Gatos held on the 5th day of May 1986 by
the following vote:
