RESOLUTION DENYING APPEAL OF BUILDING
OFFICIAL DECISION CONCERNING HOUSING
CODE CORRECTION REQUIRED FOR APPROVAL
OF SECONDARY DWELLING UNIT
(17231 Wedgewood Avenue -- John & Judith Aitken)
WHEREAS:
1. John Aitken and Judith Aitken appealed a portion of the decision
of the Building Official on what corrections are necessary to make the
secondary dwelling unit at 17231 Wedgewood Avenue comply with the
Uniform Housing Code as follows:
a. Add perimeter concrete foundation and provide minimum
clearance to ground with adequate underfloor ventilation.
b. Modify roof framing to provide a minimum of seven feet
of head -room at lowest end; joist to be sized and spaced
to meet minimum Building Code requirements at both roof
and floor.
C. Modify bathroom to give seven foot minimum high ceiling
and six foot, eight inch high doorways.
2. A public hearing was held by the Town Council on March 17, 1986;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the inspection procedures
and interpretations of the Town Housing Code and Town Building Code
by the Building Official are reasonable and that secondary dwelling
units must meet minimum standards of the Housing Code or recognized
construction standards that may have been practiced at the time of
the original construction, including the following:
a. Building to be supported by a foundation system capable
of providing underfloor ventilation for wood frame
construction.
b. Structural framing of floors, roof, ceiling„ and walls
shall be reasonably capable of supporting imposed loads.
C. Seven -foot minimum ceiling height for habitable room,
except that sloping ceiling may be allowed when an
average height of seven feet is provided.
d. Minimum doorway height of six feet, eight inches.
2. The Town Council further finds that compliance with said
standards is necessary for the preservation of health, safety and
general welfare of the inhabitants of secondary dwelling units and
of the community.
3. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos held on the 7th day of April 1986 by the
following vote:
