RESOLUTION DENYING APPEAL FROM PLANNING
COMMISSION DENIAL OF ARCHITECTURE AND
SITE APPLICATION REQUESTING TREE REMOVAL
(287 Desoto Drive -- DeSoto Condominium Assoc.)
WHEREAS
1. Daniel Weinstein has appealed a decision of the Planning
Commission as follows: denial of Architecture and Site
Application S -77 -2C requesting permission to remove a sycamore
tree on property located in the R- M:5 -12 zone at 287 DeSoto
Drive and owned by the DeSoto Condominium Association;
2. A public hearing was held by the Town Council on
December 2, 1985;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission
decision was correct to deny the request for removal of the
sycamore tree.
2. The Town Council further finds that the tree is healthy
and not causing structural problems in accordance with Town
Zoning Ordinance Section 3.20.70(1).
3. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Section 1 -15, the time for
seeking judicial review for the Town Council decision is governed
by California Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Los Gatos held on the 16th day of December , 1985
by the following vote:
