RESOLUTION REFERRING TO THE PLANNING COMMISSION
THE APPEAL OF THE PLANNING COMMISSION DENYING
REQUEST TO CONVERT EXISTING SINGLE FAMILY RESIDENCE
INTO AN OFFICE.

WHEREAS:
1. Dena White has appealed a decision of the Planning Commission as
follows: denial of Architecture and Site Application S -85 -38 requesting
approval to convert an existing single family residence into an office
use in the 0 -LHP Zone at 30 Broadway; and
2. A public hearing was held on October 21, 1985;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the Planning Commission erred in
denying the application on the basis of use because the property is
zoned 0 -LHP (Office, Landmark and Historical Preservation Overlay Zone);
2. The Town Council further finds that the application is too intense
based on the standards of review in Zoning Ordinance Section 4.86.180
governing applications relating to property in the Landmark and Historic
Preservation Overlay Zone based on the existence of an adjacent residence
and its location within the Broadway Historic District.
3. Based on the foregoing findings, the appeal is referred to the
Planning Commission with review by the Development Review Committee to
consider the following:
a. Delete second driveway,
b. Review intensity of on -site parking,
C. Limit on -site parking spaces to 4 or 5 spaces,
d. Consider a variance if necessary to assure adequate
parking,
e. Consider less floor area to be used for office,
f. Provide appropriate screening to the conditions before
trees were removed from the rear yard,

g. Landscape the rear yard closest to the residential
property;
h. Provide landscape buffer along side of property adjacent
to residential property.
i. Prohibit signing along the frontage, and
j. Prohibit lighting near the residential property.
PASSED AND ADOPTED at a regular meeting of the Town Council of the
Town of Los Gatos held on the 4th day of November 1985
by the following vote:
