RESOLUTION DENYING APPEAL FROM PLANNING COMMISSION
DECISION DENYING ARCHITECTURE AND SITE APPLICATION
FOR OFFICE GUIDING
(407 Alberto Way -- Westland Investments)
WHEREAS:
1. Jose A. Debasa on behalf of applicant Westland Investments has
appealed a decision of the Planning Commission as follows: denial of
Architecture and Site Application S -85 -30 requesting approval of a
4,188 square foot office at 407 Alberto Way;
2. A public hearing was held on September 16, 1985;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that the decision of the Planning
Commission was correct.
2. The Town Council further finds that the limit of 3,500 trips per
day on Alberto Way north of Saratoga Avenue for the total development of
land in the Alberto Way basin as set forth in Town Resolution No. 1980 -102,
is a limit, not a goal, and that unused trips for a parcel shall not be
allocated to another parcel in the basin.
3. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Sections 1 -15, the time for seeking
judicial review for the Town Council decision is governed by California
Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council
of the Town of Los Gatos held on the 21st day of October , 1985
by the following vote:
AYES: COUNCILMEMBERS Eric D. Carlson, Thomas J. Ferrito,
and Mayor Joanne Benjamin
