A RESOLUTION SETTING A PUBLIC HEARING FOR CONSIDERATION OF
ESTABLISHING UNDERGROUND UTILITY DISTRICT 85 -1, PROJECT 318
ALONG VILLAGE LANE (SARATOGA AVENUE TO BACHMAN AVENUE)
WHEREAS, Article III of Chapter 32 (Sections 32 -14 through 32 -23) of the Los
Gatos Town Code, provides procedures for the establishment of Underground Utility
Districts and requires a public hearing for consideration of such district; and
WHEREAS, the Town has proposed the establishment of Underground Utility District
85 -1, Project No. 318 and has recommended that the boundaries of said District, be as
described in the notice of hearing attached hereto.
NOW, THEREFORE, BE IT RESOLVED that the 15th day of July, 1985 at the hour of
8:00 p.m., in the Council Chambers of the Civic Center, 110 East Main Street, Los
Gatos, California, is hereby established as the date, time and place of a public
hearing by the Town Council to consider the establishment of said Underground
Utility District 85 -1, Project No. 318.
BE IT FURTHER RESOLVED that the Town Clerk is hereby directed to notify all
affected property owners and utilities, at least thirty (30) days in advance of said
hearing, by mailing each a "Notice of Hearing" in the same form as that notice
annexed hereto.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos held on 20th day of May , 1985 by the

NOTICE IS HEREBY GIVEN that the Town Council of the Town of Los Gatos has set
the hour of 8:00 p.m., on Monday, the 15th day of July, 1 9885, in the Council
Chambers, Town Hall, 110 East Main Street, Los Gatos, as the time and place for
public hearing to ascertain whether the public necessity, health or safety
requires the removal of poles and overhead wires and associates overhead
structures from the public streets, alleys, or ways, and the underground
installation of wires and facilities for supplying electric, communication, or
similar or associated services, within the area designated "Underground Utility
District 85 -1, Project No. 318" a description of which is attached hereto as
Exhibit "A" and map of Underground Utility District 85 -1 as Exhibit "B ", and
are made a part hereof by reference.

UNDERGROUND UTILITY DISTRICT 85 -1
BEGINNING at the intersection of the Southeasterly line of Village Lane a<
shown upon the map entitled "Tract No. 514 - Little Village" which map Ora
filed July 19, 1948, Book 18 of Maps, Page 55, Santa Clara Records, with
the Southwesterly line of that parcel of land described in the deed to the
State of California, recorded February 9, 1957, Book 3726 of Official
Records, Page 58, said Southwesterly line being also the Southwesterly
line of Saratoga Avenue; thence along the Southwesterly line of land to
the State of California S 53° 04` E 98.93 feet to a point on the
Northwesterly line of lands formerly of the Southern Pacific Railroad
Company (now Town of Los Gatos); thence leaving said point S 20' 46' 30"
W., 603.95 feet to a point on the Northeasterly line of Bachman Avenue as
shown on that certain map entitled "Record of Survey, a Portion of Parking
Assessment District No. 2 ", recorded on March 17, 1967, in Book 220 of
Maps, Page 2, Santa Clara County Records; thence leaving said point N 64°
33' W., 173.73 feet; thence along a curve to the right having a radius of
199.60 feet, through an angle of 11° 37' 20 ", a distance of 40.49 feet to
a point of compound curvature, said point being a curve to the right
having a radius of 20.00 feet, through an angle of 64° 17' 35 ", a distance
of 22.44 feet to a point on the Southeasterly line of Santa Cruz Avenue;
thence leavina said point and along said Southeasterly line N 20° 15' E.,

RECOMMENDATION
Adopt a resolution setting a public hearing for consideration of estahlishina
underground Utility District 85 -1, Village Lane.
DISCUSSION
The proposed Capital Improvement Program calls for undergrounding of the utilities
along Village Lane in the 1986/87 fiscal year. This project is planned to be a PG &E
Rule 2.0 -A project. This means that PG &E will pay for the undergroundino of their
facilities if the project meets their criteria. One requirement is that the Town
adopt an ordinance requirinq all utilities to be underground. In order for PG &E to
meet their scheduled start of construction date, May, 1986, the Town must adopt the
ordinance in July, 1985. This schedule would provide for PG &E to complete their
construction work in September, 1986, property owners complete their service
conversions by November 30, 1986 and poles and overhead lines removed by December
31, 1986.

The procedure followed on prior projects includes a public hearing to consider
formation of the underground utility district. The attached draft resolution sets

notice to the affected property owners listed on Exhibit "C ". The attached'Exhibit
"B" shows the boundaries of the proposed underground utility district.
General Telephone has in the past agreed to underground their facilities at their
cost when PG &E undergrounds its facilities using Rule 20 -A funds.
Cable television facilities must be undergrounded when the PG &E and telephone
facilities are undergrounded.
The project is estimated to cost approximately $170,000 in PG &E Rule 20 -A money and
will include installation of Town electroliers as a separate project. The attached
Exhibit "C" is a list of the names of the property owners in the proposed district
by Assessor's parcel number. The list indicates on -site and absentee property
owners, with addresses. Exhibit "D" shows the assessor's parcels, numbers and
whether the property is residential commercial or a combination thereof. The map
shows that the majority of the parcels are commercial.
