1984-198-Denying Appeal From Planning Commission Approval Of Subdivision Application For Lot Line AdjustmentRESOLUTION NO. 1984 -198 RESOLUTION DENYING APPEAL FROM PLANNING COMMISSION APPROVAL OF SUBDIVISION APPLICATION FOR LOT LINE ADJUSTMENT (15060 Greenridge Terrace - Mrs. W. R. Morgan) WHEREAS: 1. Susan Fish has appealed a decision of the Planning Commission as follows: approval of Subdivision Application M -83 -8 for a lot line adjustment for property located at 16050 Greenridge Terrace and owned by Mrs. W. R. Morgan; 2. A public hearing was held on October 15, 1954; IT IS HEREBY RESOLVED: 1. The Town Council hereby finds that the findings of the Planning Commission were correct as follows: The subdivision is consistent with the General Plan and Hillside Specific Plan and reasons for denial as specified in the Subdivi- sion Map Act do not exist. 2. The Town Council further finds that the decision of the Planning Commission was correct (except as to paragraph "b" which is Hereinafter modified) to approve Subdivision Application M -83 -8 with the following conditions: a. A parcel map shall be filed to the satisfaction of the Town Engineer. b. The joint use portion of the existing Greenridge Terrace driveway shall be widened to a minimum of 15 feet and plans shall indicate grading impacts delineated by suitable cross - sections and possible impacts on existing trees. The Larga Vista right -of -way bordering the Morgan parcels shall be maintained by the applicant, to the satisfaction of the Town Engineer. For the record, "maintaining" shall include such things as clearing weeds, debris or brush, trees that fall across it and shall not mean things like paving. C. Plans for driveway improvements shall be submitted to and be approved by the Town Engineer prior to the filing of the parcel map. An approximately 70 foot long reciprocal ingress /egress access easement and maintenance agreement over Parcel 1 and the proposed Parcel 2 shall be executed to the satisfaction of the Town Engineer. d. Any future vehicular access to Parcel 1 shall be from the existing driveway now serving Parcel 2. e. The developer shall install one (1) hydrant to meet Central Fire Protection District's specifications. All fire hydrants shall be installed and accepted prior to construc- tion of any buildings. Contact should be made with the water company as soon as possible to eliminate engineering delays. 3. Based on the foregoing findings, the appeal is denied and Subdivision Application H -83 -8 is approved subject to the following modified condition H b,e b. The joint use portion of the existing Greenridge Terrace driveway shall be widened to a minimum of 15 feet and plans shall indicate grading impacts delineated by suitable cross - sections and possible impacts on existing trees. The Larga Vista right -of -way Lordering the Morgan parcels shall be maintained by the owner to the satisfaction of the Town Engineer. No gate shall be allowed to block said Larga Vista right -of -way; however, a chain with a locking device acceptable to the Central Fire District shall be permitted. For the record, "maintaining" shall include such things as clearing weeds, debris or brush, trees that fall across it and shall not mean things like paving." Pursuant to Los Gatos Town Code Section 1 -15, the time for seeking judicial review for the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a re f meeting of the Town Council of the Town of Los Gatos held on the 5th day of November 1934 by the following vote: AYES: COUNCILMEmBERS Joanne Benjamin, Eric D.
