1983-130-Granting Appeal From Decision Of Planning Commission-Villa VasonaWHEREAS: RESOLUTION NO. 1983 -130 RESOLUTION GRANTING APPEAL FROM DECISION OF PLANNING COMMISSION (612 West Parr Avenue - Villa Vasona) 1. Gail Brough has appealed a decision of the Planning Commission as follows: approval of Architecture and Site Application S- 83 -14; and 2. A public hearing was held by the Town Council on June 6, 1983; IT IS HEREBY RESOLVED: A. Council Decision 1. The Town Council hereby finds that the Planning Commission erred in the following respects: a. It overlooked the fact that HUD is now willing to finance solar hot water, and therefore failed to require same as a condition of the project. b. It overlooked the fact that the distance project tenants would have to walk to laundry facilities without shelter is too far in bad weather. 2. Based on the foregoing findings, the appeal is granted in part, and the approval of the Planning Commission is modified to add new conditions regarding solar how water and additional laundry facilities, the conditions as modified being as follows: B. Conditions 1. The applicant shall comply with all conditions adopted in Ordinance No. 1572 for this project. 2. If the Planning Commission on request of any interested party deter - mines that a need exists for additional handicapped parking, the then owner shall, at its sole expense, cause the spaces shown as 'overflow parking" on the specific plans to be restriped to provide for such handicapped parking. These spaces shall be surfaced appropriately for the handicapped. One of the other two rows of parking in this area shall be paved with asphalt or concrete. 3. The landscape plans will be revised to the satisfaction of the Superintendent of Parks and Forestry, emphasizing long -lived evergreens or confers which will eventually exceed the height of the buildings. 4. The following shall be provided, to the satisfaction of the Central Fire Protection District: a. Provide turnout area along the emergency access road at any hydrant location. Turnout area shall be large enough to allow for fire truck operation at the hydrant and still allow a second truck to pass. b. Access road shall be 18 feet or more. c. Install two (2) hydrants framing of any buildings. Hydrants to be installed prior to d. Sprinkler the buildings and provide smoke detectors and alarms, as appropriate, subject of the satisfaction of the Building Official. 5. Domestic hot water for the units shall be provided by solar heating in accordance with the requirements of the Solar Demonstration Program of the California Public Utilities Commission. 5. Each three -story building in the project shall have a laundry facility with a minimum of two (2) washers and two (2) dryers. -2- PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos this 20th day of June, 1983, by the following votes: AYES: Council Members Joanne Benjamin Terrence J.
