RESOLUTION DENYING APPEAL FROM DECISION OF BUILDING OFFICIAL
(15200 Los Gatos Boulevard - The Flames Coffee Shop)
WHEREAS:
1. Fred Long has appealed a decision of the Building Official,
as follows: requiring provision of handicapped access on an existing
building in connection with remodeling; and
2. A public hearing was held by the Town Council on May 2, 1983;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds as follows:
a. The Flames Coffee Shop receives intensive public use and
therefore requires handicapped access.
b. In contrast to shopping centers, where other restrooms
with access may be available close by, this facility is by itself.
c. In view of the foregoing considerations, the cost of
providing handicapped access is not unreasonable in comparison to the
cost of the remodeling.
d. For the foregoing reasons, the decision of the Building
Official was correct.
2. Based on the foregoing findings, the appeal is denied.
PASSED AND ADOPTED at a regular meeting of the Town Council of
the Town of Los Gatos this 16th day of May, 1983, by the following votes:
