RESOLUTION NO. 1983 -40
RESOLUTION GRANTING APPEAL FROM DECISION OF BUILDING OFFICIAL
(16005 Los Gatos Blvd. - Swanson Ford)
1. Swanson Ford has appealed a decision of the Building Official, as
follows: requiring provision of handicapped access on an existing building in
connection with remodeling; and
2. A public hearing was held by the Town Council on February 7, 1983;
1. The Town Council hereby finds as follows:
a. The subject building is a building which existed prior to the adoption
of 24 California Administrative Code Section 2- 105- 17.A(5).
b. The total cost of the proposed addition does not exceed the valuation
threshold in Section 2 -105.
c. Compliance with sub - Section 11A(5) would create an unreasonable hard-
ship for the following reasons:
the addition.
(1) The cost of compliance would be approximately 25% of the cost of
(2) The sanitary facilities that strict compliance would require be
made accessible are used only by employees of the subject office, not by the general
public.
(3) The increase in usage of the office by the applicant is small in
relationship to the cost of compliance.
2. Based on the foregoing findings, the appeal is granted, and the Building
Official is authorized to issue a building permit upon appellant's compliance with
the following conditions on handicapped access:
a. Ranp access to addition.
b. Modification of existing drinking fountain.
c. Installation of grab rails in restrooms in main showroom.
PASSED AND ADOPTED AT A regular MEETING OF THE TOWN COUNCIL OF
THE TOWN OF LOS GATOS THIS 22 day of February 1983, by the
following votes:
AYES: COUNCILMEMBERS Joanne Benjamin, Terrence J. Daily, Thomas J.
Ferrito, Marlyn J. Rasmussen and Mayor Brent N. Ventura
