RESOLUTION GRANTING APPEAL FROM DECISION OF BUILDING OFFICIAL
(236 North Santa Cruz Avenue - Bateman - Eichler)
1. Bateman- Eichler has appealed a decision of the Building Official, as
follows: requiring provision of handicapped access on an existing building in
connection with remodeling; and
2. A public hearing was held by the Town Council on January 17, 1983;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds as follows:
a. The subject building is a building which existed prior to the adoption
of 24 California Administrative Code Section 2- 105- 11A(5).
b. The total cost of the proposed addition does not exceed the valuation
threshold in Section 2 -105.
c. Compliance with sub - Section 11A(5) would create an unreasonable hard-
ship for the following reasons:
(1) The cost of compliance would be approximately 407 of the cost of
the addition.
(2) The sanitary facilities that strict compliance would require be
made accessible are used only by employees of the subject office, not by the
general public.
(3) The increase in useage of the office by the applicant is small
in relationship to the cost of compliance.
(4) Requiring compliance would probably render the project financially
infeasible.
2. Based on the foregoing findings, the appeal is granted, and the Building
Official is authorized to issue a building permit without requiring compliance
with sub - Section 11A(5).
