A RESOLUTION OF INTENTION TO VACATE EXCESS PORTION OF A
PUBLIC THOROUGHFARE (VILLA AVENUE) FOR PUBLIC ROAD PURPOSES
RESOLVED:
1. It is the intention of the Town Council to vacate, under the provisions of
Division 9, Part 3 (Sections 8300 through 8331) of the Streets and Highways Code, a
public road right -of -way situated in the Town of Los Gatos, County of Santa Clara,
State of California, consisting of a strip of land approximately 280 feet long
containing approximately 103+ square feet located along the southerly side of Villa
Avenue east of Fiesta Way, and more particularly described in Exhibit "A"
(Description of Excess Portion of a Public Thoroughfare to be Abandoned [Villa
Avenue] by the Town of Los Gatos), and Exhibit "B" (Plat to Accompany Description of
Public Thoroughfare Abandonment), copies of which are attached hereto. Said
Exhibits show the particulars as to the proposed abandonment, and are available for
public inspection in the Office of the Town Clerk of the Town of Los Gatos, Civic
Center, 110 East Main Street, Los Gatos, California.
2. Public Utility Easements shall be retained over the area to be abandoned.
3. On December 6, 1982, in the Council Chambers of the Civic Center, 110 East
Main Street, Los Gatos, California, the Town Council will hold a public hearing to
consider whether or not the easement is necessary for present or prospective public
use. The meeting will begin at 7:30 P.M. All persons interested are invited to
attend and be heard.
4. The Town Clerk is authorized, and is hereby directed to publish a copy of
this resolution in the Los Gatos Times Observer, a newspaper of general
circulation, published and circulated in the Town of Los Gatos, within fifteen (15)
days after the date of its adoption.
5. The Mayor of the Town of Los Gatos is authorized, and is hereby directed to
execute that document entitled, "Notice of Abandonment of Excess Portion of a Public
Thoroughfare", a copy of which is attached hereto, and the Director of Public Works
is authorized, and is hereby directed to conspicuously post three (3) copies of said
Notice, not more than 300 feet apart, on at least 'ten (10) days before the date of
the public hearing above designated.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos held on 25th day of October, 1982 by the following vote:

PORTION OF A PUBLIC THOROUGHFARE
NOTICE IS HEREBY GIVEN that on October 25, 1982, the Town Council of the
town of Los Gatos, County of Santa Clara, State of California, adopted
Resolution No. 1982 -189 entitled, "A RESOLUTION OF INTENTION TO VACATE AN
EXCESS PORTION OF A PUBLIC THOROUGHFARE (VILLA AVENUE) FOR PUBLIC ROAD
PURPOSES ", located along the southerly side of Villa Avenue east of Fiesta
Way. A copy of said Resolution and a map entitled, "PLAT TO ACCOMPANY
DESCRIPTION OF PUBLIC THROUGHFARE ABANDONMENT ", showing the particulars as to
the proposed vacation are on file in the Office of the Town Clerk of the Town
of Los Gatos, Civic Center, 110 East Main Street, Los Gatos, California, and
are available for inspection during regular business hours.

follows:
BEGINNING at a 3/4" iron pipe set at the northwesterly
corner of that certain parcel of land described in Lhe
Deed from i.C.Kimble, et ux, to i.i.Fretwell, in
March 9, 1894, recorded April 9, 1894, in Book 169 of
Deeds, page 198, Santa Clara County Records, said point
of beginning being also the northeasterly corner of
that certain parcel of land described in the deed from
Barbara Ashley Wainwright and Robin W. Wainwright to
Eva V. Ogilvie, recorded December 18, 1979 in Book F
23 at page 587, Santa Clara County Official Records,
thence from said point of beginning, along the northerly
line of said lands of Ogilvie N89002'45"W 60ZO feet to
the northwest corner thereof, said last mentioned point
being also the northeasterly corner of that certain
parcel of land described in the deed from Walker to
Ogilvie recorded September 12, 1979 in Book E 784 at
