1982-101-Adopting The Los Gatos Downtown Specific PlanRESOLUTION NO. 1982 -101 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ADOPTING THE LOS GATOS DOWNTOWN SPECIFIC PLAN WHEREAS, (1) under the provisions of Government Code section 65503, the Town Council of the Town of Los Gatos conducted a public hearing for consideration of adoption of the Los Gatos Downtown Specific Plan and its environmental impact report (EIR), in sessions held on March 22, March 29, and May 18, 1982. (2) under the provisions of Government Code section 65500 and section 15165 of the Guidelines for Implementation of the California Environmental Quality Act of 1970 and the provisions of Town Council Resolution No. 1976 -161, the Town Planning Commission had previously conducted a public hearing concerning the certification of the EIR and adoption of the Los Gatos Downtown Specific Plan, and on February 22, 1982 recommended that the Town Council certify the EIR and adopt the plan. (3) during its hearing the Town Council considered all of the matters shown in Resolution No. 82 -2 of the Town Planning Commission. (4) under Govenment Code section 65504, the Town Council referred several amendments to the Planning Commission for report and has received a written report dated April 29, 1982 from the Planning Commission. RESOLVED: (1) The Town Council finds that the final EIR for the Los Gatos Downtown Specific Plan as recommended for certification by the Planning Commission on February 22, 1982 is prepared in compliance with the California Environmental Quality Act and guidelines and is complete. The EIR is hereby certified. (2) the Town Council finds that the Los Gatos Downtown Specific Plan as recommended by the Planning Commission on February 22, 1982, as amended by this resolution, (a) meets the requirements for a specific plan, (b) is consistent with the Town General Plan, and (c) that all proceedings have been conducted in compliance with the provisions of Government Code section 65500 through 65504. (3) the Los Gatos Downtown Specific Plan (including text and maps attached hereto, Exhibit A) is hereby adopted as an official specific plan with the following changes (including Exhibits 8 and C): The format of the changes are [brackets] indicate deletion and underscorin indicates additions. II. LAND USE 1. Page II -3 POLICIES #6 Due to the existing physical constraints of downtown streets (i.e. the inability to widen the two -lane roads) future intensification of use and new developments shall be keyed to the traffic carrying capacities of the streets and intersections in the Downtown. The traffic in the downtown area has reached a level so that little more can be tolerated without some improvements in the street capacity. The alternatives for changes in the street capacity are limited, consequently the potential for further development is also limited. 2. Add new Policy #10. If the traffic capacities are improved, additional housing shall have priority over additional commercial or office developments. 3. Add new Policy #11. Existing residential uses will be recognized. 4. Add new Policy #12. The existing open space in public use areas e.g. Los Gatos Creek Trail, Town Center, Pageant Grounds and the High School turf areas and playing fields shall be preserved. Add new Policy #13. Because of the traffic and public safet problems, no new bars and /or restaurants shall be approved unless they can demonstrate that they do not impact either problem. 6. Add new Policy #14. Any new deck constructed over the Old Town depressed parking lot may not be used for commercial purposes.. - 2 7. Page II -5 IMPLEMENTATION Add new Implementation C. University Avenue 1. Consider rezoning existing office uses on University Avenue between Mullen and Saratoga from C -2 to 0 Office 2. Rezone the remainder of University Avenue between Mullen and Saratoga from C -2 to R -1D. 8. IMPLEMENTATION Add new Implementation D. Open Space T. The open space areas such as the Hi h Schoo playing fields, Ba zer Field, the Town Plaza, the turf areas in front of the Civic Center and High School, the former Pageant grounds and the Youth Park should be designated as open space on the Land Use Mao fia. II -1 9. 3. Rezone the Town Plaza, Balzer Field, the Youth Park and the former Pageant grounds to RC. 10. Add new Implementation E. Downtown Residential Areas 1. Amend the R -ID zone to allow existing mortuaries with a conditional use permit. 11. Fig. II -1 Amend the Land Use Plan: 1. To show High School fields, the former Pageant Grounds behind the Civic Center, the turf areas in front of the Civic Center and high school and properties adjacent to Youth Park as open space. 2. To show Los Gatos Creek Trail. 3. To add a heavy black line as a border around all commercial zones. The line should follow property lines precisely. 4. To move the boundary of the CBD on West Main Street further east to exclude the Los Gatos Museum. NOTE: These changes have been incorporated in Exhibit A - 3 - 12. Fig. II -2 Amend the Recommended Zone Changes Map: 1. To rezone the office properties on University Avenue to 0 (Office). 2. To rezone the Town Plaza, Balzer Field, the Youth Park and the former Pageant Grounds to RC. 3. To rezone the mortuary and museum on West Main Street to R -ID. NOTE: These changes have been incorporated in Exhibit B. IV PARKING 13. Page IV -2 POLICIES Add #17. The "build -out" allowed under current emulations governing properties located in parking assessment districts is not acceptable and must be reduced. 14. Page IV -3 IMPLEMENTATION A. Parking Standards. 1. The zoning ordinance shall be amended to include the following parking standards for the downtown area: Retail Uses: One Parking Space per 300 square feet Offices /Services: One Parking Space per 250 square feet Restaurant: One Parking Space per (No separate bar) 4 seats Restaurant: One Parking Space per Separate bar) T seats Bar: One Parking Spacee per 3 seats 2. Parking standards for downtown commercial areas within the CBD are recommended to be: 80% of the parking spaces calculated using the ratios above except for bars and restaurants with separate bars. Said activities must comply with fhe standard parking requirement. The factor of 80% percent is included to account for the multiple use characteristics of parking within the CBD given the land use pattern and the proposed consolidated CBD parking program. - 4 - 15. Page IV -4 IMPLEMENTATION B.3. Add sub - section F. Include consideration of the fiscal implications to the Town for the construction and operation of the parkin facilities and the enforcement of the parking regulations. 16. Page IV -4 IMPLEMENTATION B.3. Add sub - section G. Set limits on the amount of floor area permitted in properties within the unified CBD parking district. 17. Page IV -5 IMPLEMENTATION o The Meadow Gold site as well as the Greco and Boyle properties should be utilized for parking. 18. Page IV -5 The following parking facilities shall be considered before any decking is proposed (except for number 2): 1. Surface lot on the former Meadow Gold Boyle & Greco properties in conjunction with the Town -owned property between Grays Lane and Elm Street, approx. 175 spaces. 2. Deck over the Old Town lot at the southwest corner of University and Elm, approx. 95 spaces. 3. Surface lot at Park Avenue and Main Street, approx. 18 spaces. The Parking Committee should study the possibility of including this lot as part of the larger Park Avenue plan for a public Parkinq lot incorporating the Telephone 4. Surface lot on Town -owned property between Royce and Grays Lane, approx. 54 spaces. [5. Surface lot on Town property at the foot of Miles Avenue (next to the Town Service Center), approx. 68 spaces. This site may only be used for parking if access is constructed via Mullen Avenue instead of Miles.] Potential deck parking improvements are identified in Table IV -3 and their locations are diagrammed in the Technical Appendix. There is potential for up to 338 additional spaces, following the criteria above. 5 _ 19. Page IV -6 IMPLEMENTATION D. Neighborhood Parking Program A residential permit parking program on streets adjacent to the CBD shall be considered to reduce the impact of downtown parking on nearby residential areas. Several variations of a residential parking permit program are possible. Some of the alternatives are: o Non - residents are prohibited from parking during certain hours of the day. o Non - residents are prohibited from parking both during the day and at night. o Non - residents are permitted to park for limited amounts of time in the regulated areas. The selection of a specific program will depend on the desires of neighborhood residents and the Town Council will initiate programs on a trial basis for the streets listed below. [Residential permit parking is recommended for the following streets because of their proximity to the CBD :] The specifics of the Parkinq plan and the particular areas to be included will be subject to neighborhood input and public hearings. o Wilder Avenue between Bean Avenue and Bachman Avenue. o Bachman Avenue between Wilder Avenue and [Tait] Massol Avenue. o Main Street from Lyndon Avenue to Bayview Avenue. o Edelen Avenue between Mullen Avenue and Bentley Avenue. o Broadway between Santa Cruz and West Main Street. o Tait Avenue between Bean Avenue and Almendra Avenue. - 6 - Other streets could be included or a CBD ®wide program could be implemented. * Delete the following; [The Town can proceed in establishing preferential parking by: o Implementing a trial program on designated streets, and /or o Adopting guidelines for residential permit parking on any residential streets in the downtown area. In either case, close coordination with affected residents is of prime importance.] The preferential parking program shall be coordinated with the CBD parking program, such that preferential parking [could] will begin within twelve months of the adoption of this plan. One method for implementing a preferential parking program is given in the Technical Appendix. V. CIRCULATION AND TRANSPORTATION 20. Page V -1 ISSUES Add new #9 Concern for the fiscal impact of constructing additional parking and transportation facilities vs. the fiscal impact of not constructing additional parking and transportation facilities. 21. Page V -2 POLICIES Add new #6 All circulation and transportation improvements shall take into consideration the fiscal implications to the Town for the construction, operation of such improvements and the enforcement of any associated regulations. 2.2. Page V -2 *IMPLEMENTATION A. Traffic Diverters Traffic diverters may will be implemented as a means of reducing the amount of non - residential traffic utilizing residential streets as alternative routes to congested arterials. Any diverters shall be first installed on a trial basis including landscaping. The initial installation will be [at the corners of] along [Bachman and] Tait and San Benito [and Andrews on a trial basis. As a result of the public hearing, [the Planning Commission will recommend to] the Town Council will decide whether or not to install temporary diverters and what type of diverters. [Sixty days after installation, a second hearing shall be held to determine whether diverters shall remain. Residents may subsequently petition for a hearing to remove the diverters.] A subsequent hearing shall be held by the Council to review diverters. Upgrade traffic control equipment at these intersections and install interconnect control equipment. 2. Eliminate crosswalk at Main and Montebello. 3. Each request for review shall be analyzed and a determination made on: 1. The ability of critical roadways and major intersections to accommodate existing traffic; 2. Increased traffic estimated for approved developments not yet occupied; and 3. Definitions Project: Any application for building permit, use permit, application for subdivision and /or project that would be expected to add traffic to the critical roadways and /or intersections previously identified. Capacity Roadways The daily and peak hourly capacity of roadways to be determined by actual studies conducted by the Town of Los Gatos. Intersections A.M., noon, and P.M. peak hour /period intersection capacity. Lane capacity and loss time will be determined from detailed studies to be conducted by the Town of Los Gatos. 12 - 3. Required Data Each application for traffic /roadway capacity review shall be reviewed and a traffic report prepared containing the following data: (a) Traffic Generation and Traffic Distribution - Daily - A.M. Peak Hour - Noon Peak Hour - P.M. Peak Hour (b) Identification of Roadway Capacity Impact Determination: If the project adds traffic to any of the critical roadways identified, and If the addition of the project - related traffic plus other approved projects and regional growth one year after occupancy of the project exceeds the available capacity. (c) Identification of Intersection Capacity Impacts: Each of the critical intersections identified will be reviewed in conjunction with the roadway capacity analysis to identify those intersections that will be impacted by the project. Each intersection will be reviewed and analyzed to determine if the addition of project - related traffic plus other approved projects and regional growth one year after occupancy of the project exceeds available capacity of the intersection.] 2. Town Determination The deciding body shall review the application for traffic roadway /intersection capacity and make one of the following determinations: - 13 - (a) The project will not impact any of the critical roadways and intersections causing the roadways and /or intersections to exceed their available capacities. (b) The project will impact the critical roadways and intersections causing the capacity of the roadway and intersections to be exceeded. [(c) The project has been determined to have overriding social and economic benefits to the community.] Any project receiving Town determination (a) [or both (b) and (c)] may proceed. Develop standards for the rehabilitation of rear facades. Implementation 1. The Los Gatos Heritage Preservation Committee be requested to recommend additional historic districts. The following neighborhoods should be considered prime prospects: University /Edelen, Los Gatos Blvd., and Glenridge. 2. Retain existing height limits set by r the Zoning Ordinance. 3. v Redevelopment shall preserve older architecturally valuable structures unless it is unfeasible. In matters of dispute the advice of the Los Gatos Heritage Preservation Committee should be sought. 4. Department of Parks and Forestry shall develop a comprehensive landscape and streetscape plan for each sub -area. - 16 - ENVIRONMENTAL IMPACT REPORT 28. Page 12 Add: New Section E.
