A RESOLUTION GRANTING APPEAL
FROM PLALNNING COMMISSION
(14981 National Avenue - Kavanaugh)
WHEREAS:
1. Linda Kavanaugh has appealed a decision of the Town Planning Crnanission
to the Town Council, as follows: Denial of Architecture and Site Application S -81-
34A, requesting approval of plans to construct a medical office building; and
2. A public hearing was held by the Town Council an May 3, 1982;
THE TOWN COUNCIL HEREBY RESOLVES:
1. The appeal is hereby granted, based on findings that the Planning
Commission erred by not giving adequate consideration to the following factors:
a. The mixed character of the existing neighborhood.
b. The need for more medical offices in the vicinity in order to
attract the best physicians to the area.
c. The fact that although the proposed building is large, it has a
limited number of suites, and would therefore not have a serious traffic impact.
2. The Council hereby makes a negative declaration for the project, based
on the Planning Dept. report of February 18, 1982.
3. Architecture and Site Application S- 81 -31A is approved, subject to the
following conditions:
a. Conditions recommended by the DRC:
(1) The applicant shall guarantee by contract and bond, to the
satisfaction of the Town Engineer, the following improvements: National Avenue
frontage, including curb, gutter, sidewalk and paving.
(2) The applicant shall provide final circulation, grading, drainage,
on -site lighting and masonry retaining wall plans, to the satisfaction of the
Town Engineer.
(3) All trees to remain in proximity to grading and /or construction
shall be surrounded by protective fencing prior to the commencement of any work, to
the satisfaction of the Superintendent of Parks and Forestry.
(4) The fire hydrant, as required by the Central Fire Protection
District, shall be installed and accepted prior to the construction of any buildings.
(5) The applicant shall obtain cross - easements for use of the
trash containers on the adjacent property.
b. Additional conditions added by the Council, to be complied with to
the satisfaction of the Town Planning Department:
(1) Any large trees that are destroyed or die shall be replaced
by comparable trees.
(2) Additional landscaping shall be provided at the rear of the
building to screen the masonry wall from neighboring properties.
(3) The two conifers which are to be removed Linder the plans shall
be replaced by two comparable conifers.
PASSED at a regular meeting of the Town Council of the Town of Los Gatos
held on the 17th day of May 1982, by the following
vote:
