A RESOLUTION REVERSING A DECISION OF
THE TOWN PLANNING COMMISSION
WHEREAS, Mari DeVane and Lyndon Plaza Merchants have
duly and regularly filed an appeal with the Town Council, from
a decision of the Town Planning Commission as follows:
Approval of Conditional Use Permit application
U -80 -34 granting permission to operate a game
arcade for commercial entertainment in Lyndon Plaza
complex.
WHEREAS, a public hearing was held by the Town Council
on February 17, 1981.
WHEREAS, the Town Council has determined that the decision
of the Town Planning Commission should be reversed.
BE IT RESOLVED:
The decision of the Town Planning Commission is reversed
as the Planning Commission erred in its decision in that the
proposed use:
1. Is not desireable to the public convenience or
general welfare;
2. Would be detrimental to the public health, safety
and general welfare;
3. Is too intense for the center and the neighborhood;
and,
4. Would create traffic and circulation problems; and,
the Conditional Use Permit is hereby denied.
PASSED AND ADOPTED AT A regular meeting of the Town Council
of the Town of Los Gatos this 17th day of February, 1981, by the
following votes:
AYES: COUNCILMEMBERS: Ruth Cannon, Marlyn J. Rasmussen,
Peter W. Siemens, Brent N. Ventura, and Thomas J. Ferrito
