A RESOLUTION REVERSING A DECISION OF THE TOWN
PLANNING COMMISSION
WHEREAS, Frank T. Lewis has duly and regularly filed an appeal with
the Town Council, from a decision of the Town Planning Commission as follows:
Denial of Subdivision Application M- 78 -513;
WHEREAS, a public hearing was held by the Town Council on December
15, 1980;
WHEREAS, the Town Council has determined that the decision of the
Sown Planning Commission should be reversed;
13E IT RESOLVED:
The decision of the Town Planning Commission, is reversed, the
application .for tentative map is approved, based on the £findings that the
proposed subdivision is consistent with applicable General Plan.
FURTHER RESOLVED:
The approval is subject to the following conditions:
1. The applicant (property owner) shall dedicaue the existing 40
foot private right -of -way and an additional 10 feet of right -of -way on Burton
Road, to tine satisfaction of the Tows= Engineer.
2. The applicant shall guaranLee, by contract, and bond, the
installation of the following unprovenents, to the satisfaction of the Town
Engineer.
a. Burton Road (along the applicant's frontage). Standard
30 foot half improvements, plus an additional 10 feet of paving
southerly of the ceu'Lerl_ine. Improvements to include paving,
curb and gutter, iiewalks, street lights, etc.
b. Burton Road (applicant's easterly property line to Los Gatos
Boulevard). A 24 foot -wide paved roadway.
c. Storm sewers as -required.
d. Water system as required.
3. The applicant shall enter into an agreement to provide for future
sanitary sewer extension and connection for the four parcels, to the satisfactiori .
of the Town Engineer.
4. The applicant shall file a parcel map, to the satisfaction of
the Town Engineer.
5. A new septic tank system for the existing residence must be
completed and the existing septic tank abandoned, both to the satisfaction
of the Health Department, prior to approval of the final map.
6. The Santa Clara Valley Water District right -of -way shall be
shown on the final map. All work within 17 feet of the Almaden Valley Pipeline
located under Burton Road should be reviewed by Santa Clara Valley Water
District. Any crossings or work in the pipeline area will require a permit.
