1980-060-Necessity 16351 Los Gatos-Almaden RoadRESOLUTION NO, 1980 -60 RESOLUTION OF NECESSITY 16351 LOS GATOS- ALMADEN ROAD On May 19, 1980, the Town Council of the Town of Los Gatos held a hearing after notice given to the persons and in the manner required by Code of Civil Procedure Section 1245.235. Ester Davis filed, through her attorney, a written request to be heard on the matter, and her attorney, Barbara Sauer, appeared and stated that Mrs. Davis opposed adoption of the resolution of necessity, but offered no evidence. RESOLVED: 1. The public interest and necessity require the taking of the real property or interests in real property shown on the attached "Exhibit A ", which is incorporated in this resolution by reference, in fee simple, for future sale to persons who will construct housing for senior citizens with low or moderate income 2. The Town council finds and determines: (a) The public interest and necessity require the proposed project: in Health and Safety Code section 50000 et seq., the State Legislature has declared that the attainment of a decent home and a suitable living environment is a priority of the highest order, and that there is a serious shortage of decent, safe and sanitary housing for low and moderate income families; section 50005 provides that housing needs must be met at a level of government which is as close as possible to the people it serves. (b) The proposed project is planned and located in the manner that will be most compatible with the greatest public good and the least private injury because the property is suited for senior citizen housing as it is located on an arterial street with X (F -1) local bus service and near necessary retail stores and medical offices. The location and size of the land allows project design which will not adversely affect adjoining property. (c) The property described in this resolution is necessary for the proposed project because the Town has not been able to find other property which meets Department of Housing and Urban Development standards for a low income senior citizen project as well as this property does. 3. The Town Attorney is authorized to prosecute an action in eminent domain to acquire the property in fee simple absolute. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos held on the 19th day of May, 1980, by the following vote: AYES: COUNCILMEMBERS Ruth Cannon, Marlyn J.
