RESOLUTION OF THE TOWN COUNCIL OF THE
TOWN OF LOS GATOS APPROVING AMENDMENT NUMBER 1
TO THE FREEWAY AGREEMENT FOR ROUTE 85 REGARDING
ACCESS TO THE OKA/MOZART NEIGHBORHOOD AND THE
MOZART AVENUE PEDES I'RIAN OVERCROSSING
WHEREAS, the Town Council held a Public Hearing on January 7, 1991 to consider
amendments to Exhibits A and B of the Freeway Agreement between the Town of Los
Gatos and the State of California that was approved by the Town Council on October 15,
1990 (Resolution No. 1990-217); and
WHEREAS, the Town Council desires to modify Exhibits A and B of said Freeway
Agreement which left the Oka/Mozart Neighborhood Access and the Mozart Avenue
Pedestrian Overcrossing undetermined; and
WHEREAS, the State of California, through its Department of Transportation, has
requested that the Town adopt a Resolution which approves the amendments to Exhibits
A and B of said Freeway Agreement; and
WHEREAS, the revisions to Exhibits A and B of said Freeway Agreement are shown
on Exhibits A and B attached hereto; and
WHEREAS, the revisions shown on Exhibits A and B will be incorporated into a
final version of said Freeway Agreement at some future date;
RESOLVED, by the Town Council of the Town of Los Gatos that Exhibits A and
B of said Freeway Agreement attached hereto as amended are hereby approved.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 7th day of January, 1991 by the following vote.

Relocated portion from Calle Marguerita to Pollard
Road.
The roadway section from York Avenue to Wedgewood
Avenue, including the traveled way, shoulders, curbs,
sidewalks, walls, drainage installations, lighting
installations, and traffic service facilities that may be
required for the benefit or control of Pollard Road traffic.
In addition, the Town will maintain the landscaping and
irrigation system (providing the landscaping system and
irrigation system plans and specifications are approved
by the Town and the Town inspects and accepts the
installation of the Landscaping and irrigation system).
a. The roadway section, for bridge approaches,
including the traveled way, shoulders, curbs, sidewalks,
drainage installations, lighting installations and traffic
service facilities that may be required for the benefit or
control of Winchester Boulevard traffic.
b. The STATE will maintain, at STATE expense, the
entire structure below the deck surface except as
hereinafter provided. The TOWN will maintain the deck
and/or surfacing. The TOWN will also maintain all
portions of the structure above the bridge deck, as above
specified, including lighting installations, as well as all
traffic service facilities (signals, signs, pavement markings,
etc.) that may be required for the benefit or control of
Winchester Boulevard traffic. Pedestrian screens installed
will be maintained by the STATE.

hereinafter provided. The TOWN will maintain the deck
and/or surfacing. The TOWN will also maintain all
portions of the structure above the bridge deck, as above
specified, including lighting installations, as well as all
traffic service facilities (signals, signs, pavement markings,
etc.) that may be required for the benefit or control of
Lark Avenue traffic. Pedestrian screens installed will be
maintained by the STATE.
a. The roadway section for bridge approaches within
the Los Gatos Boulevard TOWN limits, including the
traveled way, shoulders, curbs, sidewalks, drainage
installations, lighting installations and traffic service
facilities that may be required for the benefit or control
of Bascom Avenue/Los Gatos Boulevard traffic.
b. The STA 1'E will maintain, at STATE expense, the
entire structure below the deck surface except as
hereinafter provided. The TOWN will maintain the
portion of the deck and/or surfacing within the TOWN
limits. The TOWN will also maintain all portions of the
structure above the bridge deck, as above specified,
including lighting installations, as well as all traffic service
facilities (signals, signs, pavement markings, etc.) that may
be required for the benefit or control of Bascom
Avenue/Los Gatos Boulevard traffic. Pedestrian screens
installed will be maintained by the STATE.
Relocated portion of Oka Road including landscaping
and irrigation system (providing the landscaping and
irrigation system plans and specifications are approved
by the Town and the Town inspects and accepts the
installation of the landscaping and irrigation system).
