RESOLUTION OF THE TOWN OF LOS GATOS AMENDING
RESOLUTION 1990-225 TO ADOPT MODIFICATIONS TO THE
RELOCATION PLAN FOR THE VILLA AVENUE RESIDENTS
WHEREAS, California Government Code Section 7260 et. seq. (Relocation
Assistance) and the Relocation Assistance and Real Property Acquisition Guidelines, 25
California Code of Regulations Section 6000 et. seq., require a public entity to adopt a
Relocation Plan setting forth the process of relocating displaced persons and families; and
WHEREAS, the Town of Los Gatos has prepared a Relocation Plan in accordance
with the California Government Code and the Relocation Assistance and Real Property
Acquisition Guidelines, setting forth the process of relocating the Villa Avenue residents
who will be displaced as a result of the new library project to be constructed on Villa
Avenue; and
WHEREAS, the draft Relocation Plan was initially adopted by the Town Council on
August 6, 1990.
WHEREAS, the Relocation Plan has been distributed to the displaced residents, the
Department of Housing and Community Development and available to the public for a
thirty (30) day comment period; and
WHEREAS, on November 5, 1990, the Town Council adopted Resolution 1990-225
approving the "Relocation Assistance and Last Resort Housing Plan"; and
WHEREAS, the Council has determined to adopt certain modifications to said Plan.
BE IT RESOLVED, that the "Relocation Assistance and Last Resort Housing Plan",
on file in the Town Clerk's Office, is amended as follows:
Amendment on Page 41, 1st paragraph. Insert after third sentence.
The comparable replacement dwellings will provide the square footage of
usable space equal to or greater than that space which the displacees now
possess. The replacement space to be provided will be suitable for the
intended use of two bedrooms, darkroom, garage, 1-bathroom, 1-laundry and
storage comparable to present attic and basement.
LOS GATOS, CALIFORNIA
Amendment on Page 42, Section D - Location of Housing to be Provided. Insert after first
sentence.
The downtown area of the Downtown Specific Plan is the logical boundary
to confine the relocation. The Relocation Plan shall include equivalent access
to shopping, and places of work and offer the displacees the proximity to
these locations that they enjoy from their present home. Any other area
south of Highway 9 within Town limits may also be considered.
Amendment on Page 44, L. Payment Policy & Procedures. Insert as last paragraph.
If the displacees use their benefit for a downpayment on the purchase of a
residence, the total benefit will be paid in a lump sum. The lump sum benefit
will be paid into a bonafide escrow account.
Amendment on Page 45. Insert item: N. Additional Compensation.
Any entitlement to additional compensation shall be determined in accordance with
the relocation plan and applicable law.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 7th day of January, 1991, by the following vote.
