RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
GRANTING THE APPEAL OF THE PLANNING COMMISSION AND
REMANDING TO THE DESIGN REVIEW COMMII'1'EE AND PLANNING
COMMISSION A REQUEST FOR APPROVAL OF A PLANNED
DEVELOPMENT APPLICATION (ZONE CHANGE APPLICATION Z-77-6A)
FOR THE DEMOLITION OF AN EXISTING RESTAURANT AND
THE CONSIRUCTION OF 24-DETACHED SINGLE-FAMILY
RESIDENTIAL UNITS ON LOTS LESS THAN THE MINIMUM ALLOWED
BY ORDINANCE ON 4.31 ACRES IN AN EXISTING 4-1:8000 PD ZONE
(15350 WINCHESILR BOULEVARD/JAMES H. SISK DEVELOPMENT.)
WHEREAS:
A. James H. Sisk Development has appealed a decision of the Planning
Commissions to deny a request for the demolition of an existing restaurant and the
construction of 24-detached single-family residential units on lots less than the minimum
allowed by ordinance; and,
B. A public hearing was held by the Town Council on March 4, 1991; and,
C. James H. Sisk Development has expressed a willingness to work with the Town
of Los Gatos to resolve issues raised by the Planning Commission.
BE IT RESOLVED:
A. The Town Council hereby finds that the Planning Commission did not err by
not finding the motel and residential use incompatible.
B. The Town Council hereby finds that the application should be remanded to the
Design Review Committee and Planning Commission for further consideration to allow
James H. Sisk Development time to prepare a proposal which will eliminate the motel and
consider alternative residential uses for 15350 Winchester Boulevard.
C. Based on the foregoing findings, the Town Council hereby grants the appeal and
remand Zone Change Application to the Planning Commission for consideration of
eliminating motel use and considering residential uses either for existing motel structure
or replacing existing motel structure.
Pursuant to Los Gatos Town Code Section 1-15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.

of Los Gatos, California, held on the 18th day of March, 1991 by the following vote.
