RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
SUPPORTING SENATE BILL 132
WHEREAS, the Town Council of the Town of Los Gatos has
adopted a Rent Mediation Ordinance to assist in maintaining a
balance between a tenant's right to housing and a landlord's fair
return on their investment; and
WHEREAS, Senate Bill 2009 has had the effect of uninten-
tionally amending Civil Code Section 798.17(e) to provide that new
purchasers in mobile home parks have no right to leases of 12
months or less; and
WHEREAS, under state law, leases of 12 months or longer
in duration are exempt for rent control, the effect of Section
798.17(e) as amended by SB 2009 is to authorize a means of
overriding local rent control measures; and
WHEREAS, SB 2009 has resultingly had the effect of
negating local authority to enact mobile home rent control ordinan-
ces;
NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DOES HEREBY RESOLVE AS FOLLOWS:
1. Support Senate Bill 132.
2. To authorize the Town Manager to convey our support
of Senate Bill 132 to the Senate Judiciary Committee
