RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF LICENSEE REGARDING PENALTY FEES IMPOSED
UPON BUSINESS LICENSE.
(800 POLLARD ROAD/JOHN R. ARCHDEACON, M.D.)
WHEREAS:
A. John R. Archdeacon, M.D., owner and applicant, has appealed the decision
of the License Collector that imposed a penalty on the $100 business license fee that was
not paid by the business in a timely manner per Town Code Section 15-14;
B. A courtesy renewal application was mailed to John R. Archdeacon, M.D., in
November 1990 and the 25 percent past due letter was mailed on January 25, 1991; and,
C. A public hearing was held by the Town Council on April 1, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the business license by John R.
Archdeacon, M.D., for the year 1991 was past due and the penalty of $25 had accrued.
B. The Town Council hereby finds that John R. Archdeacon, M.D., mailed the
business license renewal of $100 on January 4, 1991 and said payment was never received
by the Town License Collector.
C. The Town Council hereby finds that the business license of John R.
Archdeacon, M.D., for the amount of $100 with penalties of $25 for a total of $125 was
paid by John R. Archdeacon, M.D., on February 7, 1991, and that John R. Archdeacon,
M.D., has requested a waiver of the $25 penalty.
D. The Town Council hereby finds that when the original $100 license renewal
mailed to the Town License Collector on January 4, 1991 is received the Town License
Collector will return the same to John R. Archdeacon, M.D.
E. The Town Council hereby finds that it is the sole responsibility of the owner
of a business to maintain a current license.

F. Based on the foregoing findings the appeal is denied and the penalty of $25
is hereby ordered paid.
Pursuant to Los Gatos Town Code Section 1-15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOP 1'ED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 15th day of April, 1991 by the following vote.
