RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF PENALTY FEES IMPOSED UPON BUSINESS
LICENSE FOR APARTMENTS. PROPERTY LOCATED AT: 14 WEST MAIN
STREET. OWNER/APPELLANT: DANA ROGERS BURNS
WHEREAS:
A. Dana Rogers Burns, owner/applicant, has appealed the decision of the
LIcense Collector that imposed on penalty on the $460.00 business license fee that was not
paid by the business in a timely manner per Town Code Section 14-15; and,
B. A courtesy renewal notice was mailed to owner/applicant in November, 1990.
The past due penalty letter was mailed on January 18, 1991, to the address on file, to wit:
12600 Easton Drive, Saratoga, California 95070; and,
C A public hearing was held by the Town Council on March 18, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the business license for the year 1991 of
Dana Rogers Burns was past due and that the penalty of $115.00 had accrued.
B. The Town Council hereby finds that the current business license for the year
1991 in the amount of $460.00 with penalties of $115.00 for a total of $575.00 was paid by
Dana Rogers Burns on February 19, 1991, and that Dana Rogers Burns has requested a
waiver of the $115.00 penalty.
C. The Town Council hereby finds that it is the sole responsibility of the owner
of a business license to maintain a current license.
D. Based on the foregoing findings the appeal is denied and the penalty of
$115.00 is hereby ordered paid.
Pursuant to Los Gatos Town Code Section 1-15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.

of Los Gatos, California, held on the 1st day of April, 1991 by the following vote.
