1991-087-Denying Appeal Of Planning Commission Decision For Approval Of Plans For The Consruction Of Single-Family Residence In The HR-2-1/2 ZoneRESOLUTION 1991-87 RESOLUTION OF THE TOWN OF LOS GATOS DENYING APPEAL OF PLANNING COMMISSION DECISION FOR APPROVAL OF PLANS FOR THE CONS 1'RUCTION OF A SINGLE-FAMILY RESIDENCE IN THE HR-2-1/2 ZONE (ARCHITECTURE AND SI1'E APPLICATION S-90-64 (16075 CERRO VISTA DRIVE/JASON AND MICHELE BALABAN) WHEREAS: A. Mark Fredkin, appellant, on behalf of Jason and Michele Balaban, owner, has appealed a decision of the Planning Commission as follows: denial of plans for construction of a single-family residence in the HR-2-1/2 zone located at 16075 Cerro Vista Drive (Architecture and Site Application S-90-64); and B. A public hearing was held on April 1, 1991 and continued to April 15, 1991. BE IT RESOLVED: A. The Town Council hereby finds no evidence or testimony was presented that the decision of the Planning Commission was in error. B. The Town Council hereby further finds that the application should be remanded to the Planning Commission with review by the Development Review Committee for further consideration. C. Based on the foregoing findings, the appeal is denied and Architecture and Site Application S-90-64 is hereby remanded to the Planning Commission to address the issue of visibility from Wooded View Drive and the Valley floor. Pursuant to Los Gatos Town Code Section 1-15, the time for seeking judicial review for the Town Council decision is governed by California Code of Civil Procedure Section 1094.6. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California, held on the 6th day of May, 1991 by the following vote. COUNCIL MEMBERS: AYES: Randy Attaway, Joanne Benjamin, Steven Blanton, Eric Carlson and Mayor Ventura.
