RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
GRANTING THE APPEAL OF THE PLANNING COMMISSIONS DECISION
AND REMANDING TO THE DESIGN REVIEW COMMITTEE AN
APPLICATION FOR DEMOLITION OF AN EXISTING SINGLE FAMILY
RESIDENCE AND THE CONSTRUCTION OF AN OFFICE BUILDING IN THE
"0" (OFFICE) ZONE. ARCHI I'ECTURE & SI I'E APPLICATION S-86-50
(404 UNIVERSITY AVENUE/JOHN SCOTT)
WHEREAS:
A. John Scott, property owner and applicant, has appealed a decision of the
Planning Commission to deny a request of demolition of an existing single family residence
and the construction of an office building in the "O" (office) zone, Site and Architecture
application S-86-50, property located at 404 University Avenue; and,
B. A public hearing was held on May 6, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the Planning Commission erred in their
decision by finding that a community benefit could be made.
B. The Town Council hereby finds that the proposed development of the site for
an office complex is the proper use of the parcel.
C. The Town Council hereby finds that the application should be remanded to the
Design Review Committee and Planning Commission to work out a safe project with design
and landscaping)review the adequacy of on site parking, decrease the size of the building
as traffic trips are related to the size of the building, and complement the building across
from it on Saratoga Avenue in its material and design.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 20th day of May, 1991 by the following vote.
