RESOLUTION OF TOWN COUNCIL OF THE TOWN OF LOS GATOS
DENYING APPEAL OF DIRECTOR OF BUILDING SERVICES'
DECISION TO REQUIRE PRIMARY EN PRANCE ACCESSIBILITY
FEATURES.
(227 NORTH SANTA CRUZ AVENUE/APPELLANT JAMES GRIFFITHS
OWNER DELORES AND BETISTA VIERRA)
WHEREAS:
A. James Griffiths, appellant, has appealed on behalf of the property owners
Delores and Betista Vierra, a decision of the Director of Building Services requiring
primary entrance accessibility features at the business located at 227 North Santa Cruz
Avenue.
B. Staff has met with James Griffiths, appellant, on several occasions to discuss
options and construction alternatives which would provide a new primary entrance in
conformance with accessibility criteria.
C. James Griffiths, appellant, is still exploring options, but has not pursued the
options in a timely manner.
D. A public hearing was held on November 19, 1990, continued to February 11,
1991, continued to March 14, 1991 and continued to May 6, 1991.
BE IT RESOLVED:
A. The Town Council hereby finds that the Director of Building Services did not
err in requiring primary entrance accessibility features at 227 North Santa Cruz Avenue.
B. The Town Council further finds that James Griffiths, appellant, still has the right
to develop an alternative plan providing access for review and possible approval by Director
of Building Services.
C. Based on the foregoing findings, the appeal is denied.
Pursuant to Los Gatos Town Code Section 1-15, the time for seeking judicial review
for the Town Council decision is governed by California Code of Civil Procedure Section
1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 20th day of May, 1991 by the following vote.
