A RESOLUTION AFFIRMING A
DECISION OF THE PLANNING
COMMISSION.
WHEREAS, BRUCE G. JOHNSON, acting on behalf of James Lampe, the developer,
appealed the portion of the Planning Commission decision in Proceedings Nos.
V -78 -27 and S- 78 -56, which required the developer to provide an emergency street
connection across the Southern Pacific Railroad tracks and through the Courtside
property, and
WHEREAS, the Town Council, during its regular April 16, 1979, meeting held
a duly noticed hearing to determine the appeal, and received and considered
documentary and oral evidence, and
WHEREAS, the Town Council finds:
1. Two street connections to Wedgewood Avenue and permanent
emergency street connection across the Southern Pacific
Railroad tracks and through the Courtside property as
required by the Planning Commission, are necessary for
the safety of the inhabitants of the proposed project,
and to protect their property.
2. While the two street connections and the emergency connec-
tion are necessary for the project, there is no particular
community need for them except to serve the project, and
the facts do not support the conclusion that the Town
should acquire them on behalf of the developer.
3. If Route 85 were completed, the layout of the project as
proposed by the appellant, without the emergency connection,
would be wholly unsafe in that the only street serving it
would be a cul -de -sac of excessive length.
NOW, THEREFORE, BE IT RESOLVED that the decision of the Planning
Commission is hereby affirmed.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos this 16th day of April, 1979, by the following vote:
