Ord 2269 - Amending Section 2.20.025 to Increase Town Council Salaries from $200 Per Month to $570 Per Month, Effective January 1, 2019ORDINANCE 2269 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING SECTIONS 2.20.025 OF THE LOS GATOS TOWN CODE TO INCREASE TOWN COUNCIL SALARIES FROM $200 PER MONTH TO $570 PER MONTH, EFFECTIVE JANUARY 1, 2019 WHEREAS, Government Code Section 36516 establishes limits on the amount of compensation that Town Council Members may receive for their service as elected officials; and WHEREAS, Government Code Section 36516 authorizes a town to provide its Town Council Members with an initial salary of between $300 and $1,000 per month, depending upon the town's population size; and WHEREAS, Government Code Section 36516 allows the compensation for Town Council Members to be increased beyond the amount allotted by population size by ordinance or by amendment to an ordinance at a rate not to exceed five percent (5 %) for each calendar year from the operative date of any prior adjustment; and WHEREAS, no ordinance or amendment to an ordinance related to Town Council compensation can be enacted that provides for automatic future increases in compensation; and WHEREAS, Government Code Section 36516.5 specifies that a change in Town Council compensation shall not apply to a Council Member during their term of office; however, this prohibition does not prevent the adjustment of compensation for all members of a Town Council serving staggered terms whenever one or more members of such Town Council begin a new term of office; and WHEREAS, pursuant to Government Code Section 36516, the Los Gatos Town Council may receive an increase in compensation at a rate not to exceed 5 percent (5 %) of current compensation for each calendar year from the operative date of the prior adjustment; and WHEREAS, the last increase to the compensation schedule of Los Gatos Town Council Members occurred in June 1981; and WHEREAS, the Town Council is eligible to receive a 185% (37 years x 5% rate increase = 185 %) increase in compensation; and WHEREAS, any increase in Town Council compensation would not be effective until after certification of the November 2018 Municipal Election and the elected Town Council Members are seated; and WHEREAS, the Town Council desires to modify the salary compensation for all Town Council Members. Iof3 Ordinance 2269 February 6, 2018 NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY ORDAIN AS FOLLOWS: SECTION I Town Code Section 2.20.025 is amended to read as follows: Sec. 2.20.025. - Salaries. (a) Purpose. This section is enacted pursuant to section 36516 of the Government Code of the State, authorizing the Town Council to provide by ordinance that each member of the Town Council shall receive a prescribed salary. (b) Amount. Each member of the Town Council shall receive, as salary, five hundred and seventy dollars ($570.00) per month, as prescribed in section 36516 which shall be payable at the same time and in the same manner as the salaries are paid to other officers and employees of the Town. (c) Effective Date. Any increase in compensation shall become effective for all members of the Town Council no sooner than that calendar month that next succeeds the beginning of a new term of office for any member of the Town Council following the adoption of such increase. (d) Reimbursement. The salaries prescribed in this section are and shall be exclusive of any amounts payable to each member of the Town Council as reimbursement for actual and necessary expenses incurred by the member in the performance of official duties for the Town. SECTION II The Town Council finds and determines that the adoption of this ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) per CEQA Guidelines under the General Rule (Section 15061(b)(3)), which sets forth that the CEQA applies only to projects which have the potential for causing a significant effect on the environment. It can be seen with certainty that the proposed Town Code text amendments will have no significant negative effect on the environment. SECTION III If any provision of this ordinance or the application thereof to any person or circumstances is held to be invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. The Town Council hereby declares that it would have adopted this ordinance irrespective of the invalidity of any particular portion thereof and intends that the invalid portions should be severed and the balance of the ordinance be enforced. SECTION IV Except as expressly modified in this Ordinance, all other Sections set forth in the Los Gatos Town Code shall remain unchanged and shall be in full force and effect. 2of3 Ordinance 2269 February 6, 2018 SECTION V This Ordinance shall take effect thirty (30) days after its adoption. In lieu of publication of the full text of the ordinance within fifteen (15) days after its passage, a summary of the ordinance may be published at least five (5) days prior to and fifteen (15) days after adoption by the Town Council and a certified copy shall be posted in the office of the Town Clerk, pursuant to GC 36933( c)( 1). SECTION VI This Ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on January 16, 2018, and adopted by the following vote as an ordinance of the Town of Los Gatos at a meeting of the Town Council of the Town of Los Gatos on February 6, 2018. This ordinance takes effect 30 days after it is adopted.
