Staff ReportDRAFT Town Council Meeting 12/15/15 Item # MINUTES OF THE TOWN COUNCIL /PARKING AUTHORITY MEETING DECEMBER 1, 2015 The Town Council of the Town of Los Gatos conducted a Special Meeting on Tuesday, December 1, 2015, to hold a Closed Session at 5:45 p.m., and a Regular Meeting at 7:00 p.m. CLOSED SESSION — 5:45 P.M. CS -1 PUBLIC EMPLOYEE APPOINTMENT, EMPLOYMENT, EVALUATION, OF PERFORMANCE, DISCIPLINE, AND DISMISSAL (Government Code Section 54957(b)(1)1 Title: Town Attorney MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Barbara Spector, Vice Mayor Marico Sayoc, Council Member Marcia Jensen, Council Member Steve Leonardis, Council Member Rob Rennie. /. 0 T4jj Nkjr@= PLEDGE OF ALLEGIANCE David (DJ) Akers led the Pledge of Allegiance. The audience was invited to participate. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL /TOWN MANAGER REPORTS Council Matters - Council Member Marcia Jensen stated that she attended the Planned Development Committee Ad Hoc Review. - Council Member Rob Rennie stated that he attended the VTA Policy Advisory, League of Women Voters "Meet Your Elected" panel, VTA 85 Corridor Policy Advisory Board, and Cities Association Board; listened in on the Legislative Briefing Webinar from the League of Cities; attended a HAM radio class; and received his HAM radio license. - Mayor Barbara Spector stated that she attended the Art in the Council Chamber Reception, Community Development Advisory Committee Meeting, League of Women Voters "Meet Your Elected," West Valley Mayor /Manager meeting, Senior Thanksgiving, and the Parking and Infrastructure Ad Hoc Committee. - Vice Mayor Marico Sayoc stated that she attended previously mentioned events (Planned Development Committee Ad Hoc Review, League of Women Voters "Meet Your Elected "), Veteran's Day celebration, and the Los Gatos Chamber of Commerce Facebook Small Business Boost. Council Matters - continued Council Member Steve Leonardis stated that he chaired the West Valley Solid Waste Management Authority Committee and West Valley Sanitation Board of Directors General Business Meeting. Manager Matters - The annual Tree Lighting festivities will be starting at 5:00 p.m. on December 4, 2015 and the actual Tree Lighting will be at 6:00 p.m. - Saturday December 5, 2015 is the annual holiday parade, festivities starting at 11:00 a.m. - The Town is accepting Board and Commission applications through Friday December 4, 2015. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council minutes of November 17, 2015 2. PPW Project No. 813 -0224 LED Streetlight Retrofit Project a. Authorize the Town Manager to execute an energy services agreement with Pacific Gas and Electric Company (PG &E) not to exceed $500,000 for the replacement of Town and PG &E -owned streetlights with energy efficient LED streetlights. b. Approve a budget adjustment increasing project revenues by $104,648 ($62,720 from PG &E rebates and $41,928 from GFAR Fund Balance) and project expenses by $104,648 3. Hazardous Vegetation Abatement (Weeds) a. Adopt a resolution declaring Weeds a Public Nuisance and providing for their abatement b. Set January 19, 2016 as the Public Hearing date on this annual program 4. Fiscal Year 2015/16 First Quarter Budget Performance and Status Report for the Period July 1, 2015 to September 30, 2015 Accept the 2015/16 First Quarter Budget Report 5. First Quarter Investment Report (July through September 2015) for Fiscal Year 2015/16 6. Mid -year report of the annual agreement for services with the Los Gatos Chamber of Commerce and benchmarking information. MOTION: Motion by Council Member Marcia Jensen to approve Consent Items one through six. Seconded by Council Member Steve Leonardis. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Skip Saunders - Commented on the outstanding performance and efforts of Jim Harbin while working on the Friends of the Los Gatos Library Project. Town Council /Parking Authority December 1, 2015 Verbal Communications — continued Angelia Doerner - Commented on ADA Compliance in the Almond Grove Sidewalks wanting only the high risk and high exposure areas on the sidewalks to be addressed and the lower risk items be considered in the Town -wide transition plan, and cost projections for the Almond Grove project. Tom Boyce - Commented on the amount of money that the Town should be allocating to the Almond Grove Project. OTHER BUSINESS 7. New Museum Los Gatos (NUMU) and Friends of the Library (Friends) permanent signage a. Approve the New Museum Los Gatos signage proposal and the Friends of the Library request to install permanent signage to the interior wings of 106 E. Main Street and 108 E. Main Street facing the Town plaza deck. b. Provide direction for the placement of additional signage for 106 E. Main Street and 108 E. Main Street c. Approve NUMU's light pole banner design concept and encourage NUMU to apply for banners in locations that comply with the Town Policy for the placement of banners on light standards in the public right -of -way Christina Gilmore, Assistant to the Town Manager, presented the staff report. Opened Public Comment at 7:30 p.m. Barney Davidge - Commented on the difficulty patrons experience trying to find the museum due to lack of signage, NUMU needing a sign that is visible from the street, and the use of a temporary banner until permanent signage is approved. Jeffrey Janoff - Commented in favor of signage for NUMU. Brad McCurdy - Commented in support of the signage proposal for NUMU as submitted and way - finding signs for the entire Civic Center. Lisa Coscino - Commented on the presence of signage at other museums that are similar in size and location to NUMU; stated the difficulty for the community to find NUMU; spoke in favor of getting signage for NUMU, and working with the Council to do so; and thanked Jim Harbin for his effort and work with NUMU. Town Council /Parking Authority December 1, 2015 Other Business Item #7 — continued Lee Quintana - Displayed signage for Triton Museum, asked for additional signage for Town Hall and all facilities at the Civic Center, and asked that if banners were approved that all facilities be allowed to have banners, including Friends of the Library. Closed Public Comment at 7:45 p.m. Council discussed the matter. MOTION: Motion by Council Member Jensen to direct staff with options for a monument sign that represents all facilities within the Civic Center using facility logos if desired, and that is not located in the middle of the grass; to approve the interior signage for NUMU and Friends of the Los Gatos Library as proposed in Attachment 1 of the staff report; to create unified signage that identifies each facility within the Civic Center using consistent font and size; to approve the design of the light pole banners, but not the placement on the Civic Center pathway; and to allow NUMU to place their temporary banner up in accordance with all Town policies until permanent signage is in place. Seconded by Vice Mayor Marico Sayoc. VOTE: Motion passed unanimously. 8. Property Location: 16212 Los Gatos Boulevard Consider a request for approval of an exception to the story pole policy to allow an alternative to standard story pole installation to illustrate and provide notice of the proposed project. APNS: 523 -06 -010 and 011 Joel Paulson, Planning Manager, presented the staff report Scott Plautz, applicant, commented on the project. Opened Public Comment at 8:10 p.m. Brad McCurdy - Commented in opposition to the story pole exception indicating that the public may not experience the same level of concern with only a portion of the project represented by story poles. Joseph Prang - Commented on the parking lot that is widely used as a drop off location for school age children that would be adversely affected by a full set of story poles and in favor of a reduced set of story poles that would not impact the parking lot; and on the impact a full set of story poles would cause his business, especially if erected during the Christmas holiday when business is at its peak. 4 Town Council /Parking Authority December 1, 2015 Other Business Item #8 — continued Steve McGrath - Commented in favor of the story pole exception due to the impact full story poles would have on the shared parking that Yoga Source utilizes. Mr. McGrath further commented on the possibility of illegal and unsafe behavior if the property becomes fenced off with no occupants while the full set of story poles is erected. Terry Martin - Commented in opposition of the story pole exception sighting that the community will not fully understand the height, setback, and overall mass of the structure going up. Scott Plautz, applicant, responded to public comments. Closed Public Comment at 8:51 p.m. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to grant the story pole exception to the extent that full story poles be erected for ten days coinciding with a school break, either Winter break or Spring break, whichever is closest to the Planning Commission hearing, photographs be taken and posted to the Town website for public reference, widespread notice be given to the public, including methods used for noticing in the St. Mary's story pole exception, and the story poles are removed after the ten days. Seconded by Vice Mayor Marico Sayoc. VOTE: Motion passed unanimously. 9. Outdoor Seating Policy Monica Renn, Economic Vitality Manager, presented the staff report. Opened Public Comment at 9:11 p.m. Shawn Lucca - Commented on the difficulty of adding outdoor seating due to the number of overall seats for a restaurant remaining the same. Angelia Doerner - Inquired about a diagram showing the locations that could accommodate outdoor seating. Closed Public Comment at 9:17 p.m. Town Council /Parking Authority December 1, 2015 Other Business Item #9 — continued Council discussed the matter. MOTION: Motion by Vice Mayor Marico Sayoc to adopt outdoor seating policy as amended in the Desk Item. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. PUBLIC HEARINGS 10.Town Code Amendment A -13 -002. Home Occupations Amendments. Introduce Ordinance adopting amendments to section 29.10.09025 of Chapter 29 (Zoning Regulations — Home Occupations) of the Town Code to include Cottage Food Industry businesses and additional prohibited home occupation uses. Kim Castro, Special Projects Manager, presented the staff report. Opened and Closed Public Comment at 9:23 p.m. Council discussed the matter. MOTION: Motion by Council Member Steve Leonardis Move to introduce the Ordinance of the Town of Los Gatos effecting the amendments of Town Code Amendment A -13 -002 as found in Attachment 1, make the required findings that the amendments are consistent with the General Plan and its Elements, that the amendments are exempt from the California Environmental Quality Act, and to waive the reading of the Ordinance. Seconded by Council Member Rob Rennie. VOTE: Motion passed unanimously. Mayor Spector directed the Clerk Administrator to read the title of the ordinance.
