AN ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING THE TOWN CODE CONCERNING THE
APPEAL OF BUILDING OFFICIAL ACTION
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS:
SECTION 1.
Section 7.01.066 thru 7.01.069 be added to the Los Gatos Town Code to read:
SECTION 7.01.066 APPEAL NOTICE
Any interested person may appeal to the Board of Appeals from
any decision of the Building Official. The appellant must file a
written notice of appeal with the Town Clerk not more than 30 days
after the decision is rendered. The notice shall state clearly the
decision or matter being appealed.
SECTION 7.01.067 HEARING BY BOARD OF APPEAL
The appeal shall be heard by the Council within 45 days after
the filing of the appeal. The Board of Appeals may continue from time
to time any hearing held. The Town Clerk shall set the hearing date for
the appeal and shall give notice of such hearing to the appellant and the
permittee and publish a notice in a newspaper of general circulation 10
days prior to the hearing.
SECTION 7.01.068: BUILDING OFFICIALS REPORT
The Building Official shall, 4 days prior to the public hearing,
submit to the Board a report describing the decision or matter being
appealed and basis for his action, decision or interpretation.
SECTION 7.01.069: BOARD OF APPEAL HEARING
When hearing the appeal the Board shall consider the Building
Official's report, the applicable codes, regulations and standards
involved and such additional evidence or testimony given at the hearing
and may affirm, modify or reverse, in whole or part, the action being
appealed. The decision of the Council upon the appeal shall be expressed
by a written resolution, a copy of which shall be transmitted to the
original permittee, the appellant and the Building Official. If the
decision of the Board is adverse to that of the Building Official, the
resolution shall contain findings used in making their decision.
SECTION 2
This ordinance takes effect 30 days after the date it is adopted.
Within 15 days after this ordinance is adopted the Town Clerk shall
cause it to be published once in a newspaper of general circulation
published and circulated in the Town.
The foregoing ordinance was duly and regularly introduced at a
regular meeting of the Town Council of the Town of Los Gatos held on
the nth day of October , 1982.
PASSED AND ADOPTED as an ordinance of the Town of Los Gatos,
California, at a regular meeting of the Town Council held on the
25th day of October ,1982, by the following vote:

MarLyn J. Rasmussen, Peter W. Siemens and
Mayor Brent N. Ventura
