Ord 1552 - AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 61 FROM R -1:8 TO R- 1:8 -PD37 ORDINANCE NO. 1552 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 61 FROM R -1:8 TO R- 1:8 -PD SECTION I The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning on property addressed as 14700 Oka Road shown on the map which is attached hereto marked Exhibit A and is a part of this ordinance, from R -1:8 (Single Family Residential, 8,000 square foot lot size minimum) to R- 1:8 -PD (Single Family Residential, 8,000 square foot lot size minimum - Planned Development). SECTION II The PD (Planned Development Overlay) zone established by this ordinance authorizes the following construction and use of improvements: 1. Construction of thirteen (13) two -story residential condominiums. 2. Construction of one (1) two -story Below Market Rate residential condominium. 3. Construction of an eighty -six (86) space parking lot. 4. Two tennis courts, two swimming pools, a clubhouse and related existing uses of the Los Gatos Swim and Racquet Club which are located on privately owned land. 5. Landscaping, roadways and other improvements shown and required on the Official Development Plan. 6. Uses permitted are those specified in the R -1 (Single Family Residential) zone by Section 4.26.020 (Permitted Uses) and 4.26.030 (Conditional Uses) of the Zoning Ordinance, as those sections exist at the time of the adoption of this ordinance, or as they may be amended in the future. However, no use listed in Section 4.26.030 is allowed unless specifically authorized by this ordinance, or by Conditional Use Permit. SECTION III COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapter 4.10 of the Zoning Ordinance apply except when the Official Development Plan specifically shows otherwise. SECTION IV Architecture and Site Approval is required before any grading or construction work is performed, whether or not a permit is required for the work, and before any permit for grading or construction is issued. Grading or construction permits shall only be used in a manner complying with Section 4.82.120 of the Zoning Ordinance. SECTION V OFFICIAL DEVELOPMENT PLAN In addition to Exhibit A (Zone Change Map), the attached Exhibit B (Rendering), Exhibit C (Site and Parking Plan), Exhibit D (Landscape Plan), Exhibits E -G (Unit Floor Plans), Exhibit H (Rendering), Exhibits I and J (Unit Elevations) are part of the Official Development Plan. The following performance standards are part of the Official Development Plan and must be illustrated on the Precise Development Plans and /or complied with before issuance of any grading or construction permits: 1. Right -of =way shall be dedicated, to the satisfaction of the Town Engineer to provide: a. A 30 -foot half- street along the Oka Road frontage across the townhouse site and remaining swim and racquet club frontage to the north. b. A storm drain easement for the 850 -foot -long storm drain outfall to Los Gatos Creek. C. Slope and utility easements as required. 2. Guarantee, by contract and bond, the following improvements, to the satisfaction of the Town Engineer: a. Oka Road frontage (20 -foot centerline to face of curb), including curb, gutter, sidewalk, pavement, street lighting, storm drain and sanitary sewer facilities, across the townhouse and remaining swim and racquet club frontages. b. Interior street system (minimum 24 -foot- wide), including concrete vertical and extruded curb, gutter, and sidewalk, pavement (including textured crosswalks), 80 watt high pressure sodium "cut -off" style street lighting, storm and sanitary sewers and masonry retaining walls. 3. Provide grading, drainage, traffic circulation, masonry retaining wall, street lighting, erosion control plans, to the satisfaction of the Town Engineer. 4. Solar hot water heating systems shall be provided for each unit. 5. Individual ownership of the condominium units shall include membership in the Los Gatos Swim and Racquet Club. 6. Gates shall not be installed across the driveway entrance. -2- 7. Provisions for noise mitigating measures shall be constructed as required by the Negative Declaration and acoustical engineering reports. 8. Signs stating either "children at play" or 11 15 m.p.h." shall be posted along the main driveway. 9. The design of the street shall be subject to Architecture and Site approval. 10. Redwood trees shall be substituted for Eucalyptus proposed along the property bordering Highway 17. 11. The applicant shall explore the feasibility of exchanging BMP unit 12 with unit 4 and at the time of Architecture and Site approval, the Planning Commission shall determine whether the BMP unit shall be placed outside the proposed - transportation corridor. SECTION VI This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on September 13 , 1982 and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on Seetember 20 1982.
