ORDINANCE AMENDING THE ZONING ORDINANCE
PROVIDING FOR DEMOLITION PERMITS.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN:
SECTION 1.
Section 25,.10 is added to the Zoning Ordinance of the Town
of Los Gatos to read as follows:
SEC. 25.10: DEMOLITION PERMITS
Applications for demolition permits (Uniform
Building Code Section 301(a)) filed. with the Building
Department shall be submitted to the Planning Director
for approval unless such permit is required. as part of
a code enforcement action by the Building Official,
Town Council, or other authorized agency.
The Planning Director may approve the demolition
permit application if:
a. It is accompanied by a building permit for a
replacement structure which meets all Town
regulations and has received, all required
approvals.
b. It is for demolition of an accessory building
or structure.
If there is no replacement structure proposed for the
principal use of the property or where the Planning

Director determines that an accessory building or
structure should, not be removed., the Planning Director
shall transmit the application for approval of a
demolition permit to the Architecture and Site Review
Committee for decision.
The application form, fee, notice, proceedings and. appeal
procedures for application before the Architecture and.
Site Review Committee shall be the same as those required
by this Article for Architectural and Site Approval.
The Committee shall consider, but is not limited. to, the
following matters for the review of an application for
demolition permit:
a. Consideration relating to maintaining the Town's
housing stock.
b. Consideration relating to the preservation of
historically or architecturally significant
buildings or structures.
e. Consideration relating to the property owner's
desire or capacity to maintain the structure.
d. Consideration relating to the economic utility
of the building or structure.
SECTION 2.
THIS ORDINANCE SHALL TAKE EFFECT and shall be in force thirty
(30) days after the date of its adoption. The Town Clerk of the

Town of Los Gatos shall cause this Ordinance to be published. once
within fifteen (15) days after its adoption, in the Los Gatos
Times - Saratoga Observer, a newspaper of general circulation,
published and circulated in the Town of Los Gatos.
The above and. foregoing ordinance was duly and regularly
introduced. at a rya meeting of the Town Council of
the Town of Los Gatos held. on the 10 day of April ,
1974.
PASSED AND ADOPTED as an ordinance of the Town of Los Gatos,
California, at a regular meeting of the Town Council, held. on the
day of ZDr , 1974, by the following vote:
