Ordinance 1172 - AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE N0. 82 FROM PD TO CH -PD.ORDINANCE NO. 1172 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE N0. 82 FROM PD TO CH -PD. The Town Council of the Town of Los Gatos does ordain as follows: SECTION 1. The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property shown on the map which is attached hereto and is a part of this Ordinance from PD (Planned Development) to CH -PD (Restricted Highway Commercial- Planned Development). SECTION 2. Uses and Improvements Authorized. The PD (Planned Development Combining) Zone established by this Ordinance authorizes a development on the above described real property consisting of the expansion of the existing Los Gatos Lodge Hotel from 125 units to a maximum of 185 units, the ex- pansion of existing restaurant and bar facilities, the addition of a pool area, the addition of a Wedding Garden, and related vehicular parking and other improvements shown and required on the "Official Development Plan" on file with the Town Clerk and Planning Department. Construction is to be accomplished in two phases as follows: Phase I.: a. Expansion of restaurant and bar facilities. b. Construction of Building No. 8 - 26 units. C. Construction of Wedding Garden. d. Construction of Maintenance and Paint Storage Building. e. Addition of 110 parking stalls. f. Related grading and landscaping.. Phase II: a. Construction of Buildings No. 9 - 24 units and No. 10 10 units. b. Construction of pool area adjacent to Building No. 8. C. Addition of 43 parking stalls. d. Construction of an additional exit to Saratoga Avenue. e. Related grading and landscaping. SECTION 3. Official Development Plan. Prior to the issuance of any permits in compliance with the "Official Development Plan" hereby approved, precise plans shall be submitted and approved by the Planning Commission of the Town of Los Gatos pursuant to Section 20.11 of Ordinance 867. The "Official Development Plan" for the Planned Development Combining District established by this Ordinance consists of this Ordinance and the following listed plans, which are those required by compliance with Sections 20.6 through 20.9 of the Town Zoning Ordinance, and are on file in the Office of the Town Clerk and the Office of the Town Planning Department. 1. Master Plan of entire development including location of individual buildings, vehicular parking and circu- lation system, and related landscaping improvements. 2. Six sheets of plans showing Master Plan and the variations related to the phasing of the project, (labeled Al through A3, Al -X, 4, and 4A) . 3. Fourteen sheets of plans showing the proposed elevations, -2- sections, floor plans, landscaping, irrigation and lighting plans, (labeled A4 through A13, L1 through L3, and E1). In addition to the foregoing plans, the following performance standards are part of the "Official Development Plan ": 1. That adequate measures be investigated and proposed to insure the protection of those on -site trees to be pre- served. 2. That the applicant coordinate with the Superintendent of Parks and Forestry to arrive at an acceptable tree planting program for the Saratoga Avenue property frontage. 3. That each project phase stand on its own with regards to parking requirements. 4. That should Phase Il not be undertaken within a two -year period, the applicant shall secure Site and Architecture Approval for the following: a. Plans for additional "internal open space" similar to the proposed Phase 11 pool area. b. A revised parking and circulation plan. C. Final landscape plans. d. Final grading and drainage plans. e. Plans for refurbishing the existing residence on Bella Vista. 5. As a Part of Phase 1 a. Prior to issuance of Building Permits, the Developer shall enter into an agreement and provide bonds, satis- factory to the Town Attorney and Town Engineer, -3- guaranteeing that payment will be made to the Town in the following amounts: 1. Twenty -five (25 %) per cent of the bid cost for construction of traffic signals at the intersection of Saratoga Avenue and the Los Gatos Lodge entrance drive. Design of these facilities shall be in conformance with the standards of the Town and the California State Department of Transportation. 2. Fifty (50%) per cent of the bid cost for construction of Saratoga Avenue street improvements for the length of the frontage of this property, as determined necessary by the Town Engineer. Westerly of the existing Lodge entrance, the work will be limited to the south side of Saratoga Avenue, and shall provide two 12 -foot eastbound traffic lanes and a disabled vehicle lane, with concrete curb and gutter, tie -in paving, drainage facilities, and any other necessary appur- tenances. Easterly of the entrance, the work will include replacement of the existing asphalt berm on the south side with concrete curb and gutter; removal and reconstruction of the concrete median island, and new paving to provide two through traffic lanes on each side of the new island; construct new concrete curb, gutter and 4- foot -wide walkway on the north side of the street; standard street lights wired underground (south side only); fire hydrant - 4 - Of recommended by C.F.D.); drainage facilities, and any other necessary appurtenances. The agreement shall provide for the Town to complete construction of the above-described improvements within one 0 ) year of the date of issuance of building permits for Phase i of the Lodge expansion project. The property owner shall dedicate a triangular parcel of land approximately 10' x 170' for widening Bella Vista Avenue, to the satisfaction of the Town Engineer. b. The Developer shall guarantee by contract and bond the installation of half- street improvements across the Bella Vista Avenue frontage of the property, to the satisfaction of the Town Engineer. These improvements shall include, but not be limited to, curb and gutter (curb-to-curb dis- tance to be 24. to 30 feet), as required by the Town Engineer, tie -in and overlay existing pavement, street lights wired underground, drainage, and fire hydrants. -5- C. The applicant shall pay all fees due the Town, in- cluding drainage and street tree fees at the prevailing rates. SECTION 4. The Town Clerk shall attest to the adoption of this Ordinance. This Ordinance shall be published once in the Los Gatos Times - Saratoga Observer, a newspaper of general circulation, printed and published in the Town of Los Gatos within fifteen (15) days of its final passage and this Ordinance shall take effect thirty (30,) days following its final passage. The above and foregoing Ordinance was duly and regularly introduced at a meeting of the Town Council of the Town of Los Gatos held on the 19th day of August 1974.
