Ord 1275 - AMENDING, THE ZONING ORDINANICE EFFECTING ZONE CHANGEO 1 E, D I NA, N C E N O. L2 Z5.__ AN ORDINANCE OF THE TOWN OF LOS GA'TOS AMENDING, THE ZO,41NG ORDINANICE EFFECTING ZONE CHANGE NO. 145 FROM LM TO LM-PD. The Town Council of the Town of Los Gatos does ordain as follows: SECTION 7. The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property shown on the map which is attached hereto and Is a part of this Ordinance from LM (Light Manufacturing) to LH-PD (Light Manufacturing-Planned Development). SECTION 2. Uses and Improvements Authorized The PD (Planned Development Combining) Zone established by this Ordinance authorizes development on the above described real property of a four-level commercial-industrial building, landscaping, parking and other improvements shown and required on the "Official Development Plan" on file with the Town Clerk and Planning Depart- ment. Permitted uses for the project are specified by Article 15, Section 15.4 of the Zoning Ordinance (as this section exists at the time of the adoption of this Ordinance or as amended in the future), and on Page 2 of the developer's draft Environ.Tiental Impact Report, listed as follows: , a. Delicatessen b. !ce Cr caavi Parlor C. Bakery Good Store d. On-Sale Restaurant (with indoor recreation devices e. Food Store (produce market) ' f. Establishment selling alcoholic beverages for consumption on the premises (restaurant with hard liquor license) 9. Hobby Shop h. Book Store 6. Sheet No. 6: Floor plan of uRper level (Level 1) and immediate surroundings. 7. Sheet No. 7: West and north building elevations and detail of landscape buffer treatment along University Avenue. 8. Sheet No. 8: South and east building elevations. 9. Sheet No. IL: 10. Sheet No. 2L: Landscape pl-a'n. irrigation plan. In addition to the foregoing plans, the following performance standards are part of the "Official Development Plan": I. The Planning Director shall keep'a running tally of the parking requirement of.all uses to occupy the building. In no case shall the number of required off-street parking spaces be allowed to exceed the number of spaces provided. If the parking requirement equals available parking 'Prior to full occupancy of the building, re- maining vacant areas may not be used, pending adjustment of building uses which may result in a change in parking requirements. 2. That development and use of this property is subject to Sections 15.6 ("Merchandise Sales Requirements"), 15.11 ("Garbage and Waste Containers"), 15.14 ("Control of Lighting") and 15.16 ("Outdoor Storage") as such exist at the time of the adoption of this Ordinance or as amended In the future. 3. That the 20-foot easement onto adjoining property to the north be abandoned prior to the Issuance of any permits. 4. That the precise plans include a comprehensive landscape and Irrigation plan, Such plan to emphasize landscape treatment along the University Avenue frontage. 5. That the precise plans detail special measures to protect existing trees both In or near parking areas and adjacent to the building. 6. That the precise plans Include a comprehensive sign program consistent with Article 22 ("Sign Control") of the Zoning Ordinance. 7.
