Ord 1349 - AMENDING THE ZONING ORDINANCE OF THE TOWN OF LOS GATOS4 s_ � ORDINANCE NO 1349 Y ORDINANCE AMENDING THE ZONING ORDINANCE OF THE TOWN OF LOS GATOS THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN: SECTION 1. Section 2.00.110 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 2.0 0.110: CHURCH Buildings designed for, or used principally for, religious worship or religious services® SECTION 2. Section 2.00.1_50 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 2. CONVALESCENT, NURS AND REST HOME A home for ill, injured, or aged persons in which two or more persons not of the immediate family are received, kept, or provided with food and shelter or care for compensation, but not including hospitals, clinics or similar institutions. SECTION 3. Section 2 ®00.270 of - the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 2.00 ®270 JUN YARD A junk yard is any open space where waste or scrap materials are bought, sold, exchanged, stored, baled, packed, disassembled, or handled, including, but not limited to, -1- scrap metals, paper, rags, rubber tires, old building materials, old plumbing fixtures, and bottles. Junk yard includes automobile wrecking yard, any open area where automobiles are disassembled, but does not include lawful activities in buildings. SECTION 4. Section 2.00.357 is added to the Zoning Ordinance of the Town of Los Gatos to read: SEC. 2.00.357: NUMBER OF EMPLOYEES Number of employees means the largest number of persons working in direct connection with the business during any shift. SECTION 5. Section 2.00.385 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 6. Section 2.00.460 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 7. Section 3.00.010 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 3.00.010 SCOPE The provisions of Chapters 3.10 through 3.80 apply to all zones. SECTION 8. Section 3.10.040 of the Zoning Ordinance of the Town of Los Gatos is amended to read: -2- SEC. 3.10 CORRIDOR L OT The corridor to a corridor lot shall not be more than 300 feet long nor less than 20 feet wide. The area of the corridor may not be applied toward satisfying the minimum lot area requirement. A corridor may not serve more than one lot. Lot frontage for a corridor lot is an exception to the lot frontage requirements in all zones. SECTION 9. Section 3.40.020 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 10. Section 3.40.030 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 11. Section 3.40.040 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 12. Section 3.40.050 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 13. Section 3.41.010 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 3.41.010 INTE The regulations contained in this Chapter 3.41 are intended to insure the provision of a sufficient number of off- street parking spaces privately and publicly owned and operated to satisfy needs generated by permissible uses. -3- SECTION 14. Section 3.41.020 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 15. The introductory paragraph of section 3.41.030 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 3.41.030 PARKING REQUIREMENTS The minimum number of off - street parking spaces required is set in this section. When a use is not listed in this section, the Planning Director shall determine the parking requirement by analogy to the requirements for the listed uses. SECTION 16. Section 3.41.070 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 3.41.070 PROPERTIES IN PARKING DISTRICTS For any building or open -air use in a public parking district, the number of required off - street parking spaces is: (1) None, when the gross floor area of the building and open area occupied by a use, combined, do not exceed the area of the buildable portion of the zoning plot,, or (2) When the area limitation in part (1) is exceeded, - the required number is derived only on the basis of the excess area. SECTION 17. Section 3.42.050 of the Zoning Ordinance of the Town of Los Gatos is amended -to read: SEC. 3.42.050: SURFACING All outdoor off - street parking spaces, driveways and maneuvering areas shall be paved with a compacted base not less than four inches thick, surfaced with asphaltic concrete or Portland cement concrete pavement or other surfacing approved by the Director of Public Works. The paved area shall be provided with drainage facilities subject to the approval of the Director of Public Works, adequate to dispose of all accumulated surface water. Special paving may be required within the dripline of existing trees subject to the recommendation of the Superintendent of Parks and Forestry. SECTION 18. Chapter 3.70 is added to the Zoning Ordinance of the Town of Los Gatos to read: Chapter 3.70 Performance Standards SEC. 3 .70.010 : NOISE The maximum sound pressure level radiated by any use or facility when measured at the boundary line of the property on which sound is generated shall not exceed the values shown in the following table: -5- Octave Band Range in Cycles Per Sound Pressure Second Level in Decibels Below 75 72 75 - 150 67 150 - 300 59 300 - 600 52 600 - 1200 46 1200 - 2400 40 2400 - 4800 34 Above - 4800 32 The sound pressure level shall be measured with a sound level meter and associated octave -band analyzer conforming to standards prescribed by the American Standards Association. "American Standards Sound Level Meters for Measurement of Noise and Other Sounds, 224.3 -1944, American Standards Association, Inc., New York, N.Y." and "!.American Standards Specifications for an Octave -Band Filter Set for the Analysis of Noise and Other Sound, 224.10 - 1953, American Standards Association, Inc., New York, N.Y.," shall be used, and the same are adopted herewith by reference with the same effect as if herein set forth in full. SEC. 3.70.050 VIBRATION (Reserved) SEC. 3.70.100 ODORS (Reserved) SEC. 3.70.150: G LARE No direct or .reflected glare, such as that produced by floodlight, high temperature processes such as combustion or welding, or other processes, visible from outside any boundary line of property on which the glare is produced, is permitted. Glare causing sky illumination must be controlled by reasonable means so that it will not inconvenience or annoy anyone nor unreasonably interfere with the use and enjoyment of property. SECTION 19. Chapter 3.80 is added to the Zoning Ordinance of the Town of Los Gatos to read: Chaj2ter 3 ®80 Grading SEC. 3.80.010 INTENT This Chapter 3.80 regulates the issuance of grading permits (Chapter 70 of - the Uniform Building Code) and is intended to protect public and private lands from erosion, earth movement, flooding, and assure preservation of the natural scenic character of the Town by establishing standards relating to land grading, excavations and fills, and removal of vegetation, by establishing procedures by which these standards may be enforced. SEC. 3.80.020: ARCHITECTURE AND SITE APPROVAL REQUIRED No grading permit is issued without Architecture and Site Approval. Approval shall not be granted for grading except upon a finding that the purpose for which the grading is proposed is essential for a use permitted by this Ordinance and that the grading will be compatible with its environs and will result in the least disturbance of the terrain. SEC. 3.80.030: EXCEPTIONS Section 3.80.020 Architecture and Site Approval is not required when in the opinion of both the Town Engineer and the Building Official: -7- (1) The grading is limited to street improvement work over which the Town exercises inspection authority. (2) The grading is necessary to accommodate construction which has already received Town approval and the record shows that the specific grading was considered during the approval proceedings. SE C. 3. CONSIDERATIONS IN REVIEW OF APPLICATIONS The reviewing body shall consider the following factors: (1) Whether the grading is needed for a use that has been approved or which is approved in the course of the same proceedings; (2) How the grading will look when compared with everything else around it; (3) Whether the landscape is unnecessarily scarred because of the grading or removal of vegetation. SECTION 20. Sections 4.22.070, 4.22.080, 4.22.090, 4.22.100, 4.22.110 and 4.22.120 of the Zoning Ordinance of the Town of Los Gatos are repealed. SECTION 21. Section 4.26.050 of the Zoning Ordinance of the Town of Los Gatos is amended to read: 11:10 SEC. 4.26.050: LOT FRONTAGE AND DEPTH (1) Minimum lot frontage and depth requirements are: (2) The minimum frontage for a lot on a cul -de -sac bulb is 30 feet and the minimum width is 60 feet. ;,," (3) The minimum depth of lots facing or backing on.freeways, arterials, railroad rights -of -way, schools or parks is 125 feet. (4) The frontage for lots on the outside of a street curve with a deflection angle of 75 or more may be reduced to as low as 30 feet dependent on the radius of curvature. SECTION 22. Section 4.28.040 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 4.28.040 LOT WIDTH Each lot shall have a minimum width of 65 feet. SECTION 23. Section 4.28.050 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 4.28.050: LOT AREA-- SINGLE FAMILY AND TWO FAMILY DWELLINGS The minimum lot area is 10,000 square feet. Section 4.28.050 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 4.28.050: LOT AREA-- SINGLE FAMILY AND TWO FAMILY DWELLINGS The minimum lot area is 10,000 square feet. SECTION 24. Section 4.28.060 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 4.28.060 LOT AREA-- MULTIPLE FAMILY DWELLINGS The minimum lot area is 25,000 square feet. SECTION 25. Section 4.30.040 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 4.30.040: LOT AREA The minimum lot area is 8,000 square feet. SECTION 26. Section 4.30.050 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 4.30.050 LOT FRONTAGE AND DEPTH (1) The minimum lot frontage for interior lots is 60 feet and for corner lots is 80 feet. The minimum lot depth is 100 feet. (2) The minimum frontage for a lot on a cul -de -sac bulb is 30 feet and the minimum lot width is 60 feet. (3) The minimum depth of lots facing or backing on freeways, arterials, railroad rights -of -way, schools or parks is 125 feet. (4) The frontage for lots on the outside of a street curve with a deflection angle of 75 or more may be reduced to as low as 30 feet dependent on the radius of curvature. SECTION 27. Section 4.32.050 of the Zoning Ordinance of the Town of Los Gatos is amended to read: -10- SEC. 4.32.050 LOT ARE The minimum lot area is 8,000 square feet. SECTION 28. Section 4.40.070 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 29. Section 4.40.080 of the Zoning Ordinance of the Town of Los Gatos is repealed. SECTION 30. Subparagraph (18) is added to section 5.60.010 of the Zoning Ordinance of the Town of Los Gatos to read: (18) Reviews applications for construction permits for ordinance compliance. SECTION 31. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on February 22 , 1977, and adopted by the following vote as an ordinance of the Town of Los -11- Gatos at a regular meeting of the Town Council on March ?TPA 1977.
