Ord 1782 - AMENDING CHAPTER 34 OF THE TOWN CODE RELATING TO SERVICE CHARGE FOR POLICE RESPONSE TO FALSE ALARMS AND MODIFYING THE APPEAL PROCEDUREORDINANCE 1782 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING CHAPTER 34 OF THE TOWN CODE RELATING TO SERVICE CHARGE FOR POLICE RESPONSE TO FALSE ALARMS AND MODIFYING THE APPEAL PROCEDURE. Section 1. Section 34.20.25 of Article II of Chapter 34 of the Town Code is hereby amended to read as follows: Section 34.20.25 Notice To Owner Upon receipt of the report desc cause a written notice to be served system. The notice shall indicate premises, and that steps should be false alarms. The notice also shall ribed above, the Chief of Police shall upon the owner of the police alarm that a false alarm was made from said taken by the owner to prevent future state that in the event of three or more false alarms occurring on the premise within a six month period, an escalating service charge shall be assessed against the owner. Section 2. Section 34.20.40. of Article II of Chapter 34 of the Town Code is hereby amended to read as follows: Section 34.20.40. Appeals Any person who has been assessed a false alarm service charge has the right to appeal to the Town Manager (or designate) by filing a Notice of Appeal with the Town Manager within fifteen days after service of the Notice of Assessment. Filing a Notice of Appeal shall stay an assessment until the appeal has been heard by the Manager. The appeal shall be set for hearing within thirty days from the filing of the Notice of Appeal. The Town Manager may overrule, affirm or modify the decision of the Chief of Police. Section 3. Section 34.40.10. of Article IV of Chapter 34 of the Town Code is hereby amended to read as follows: Section 34.40.10 False Alarm Charges There is hereby imposed a service charge upon every owner who reports, causes to be or permits to be reported, three or more false alarms within a six month period. Said service charge shall be set by the Town Council by resolution. A separate charge shall be imposed for each false alarm beyond two within a six month period. Section 4. This ordinance takes effect 30 days after it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on February 6 1989 and adopted at a regular meeting of the Town Council on February 21 1989, by the following vote: AYES: COUNCIL MEMBERS Eric D.
