AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING_
THE ZONING ORDINANCE CONCERNING THE REQUIRED
FRONT AND SIDE YARD SETBACKS ABUTTING A STREET
IN THE CENTRAL BUSINESS DISTRICT COMMERCIAL ZONE
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS:
SECTION I.
Section 4.56.060 of the Zoning Ordinance is amended to read:
SEC. 4.56.060: YARDS
(1) Front or side abutting street: 10 feet minimum. The deciding body
may allow a reduction in the setback(s) if it makes all of the fol-
lowing findings:
(a) The setback provides for adequate pedestrian circulation;
(b) The setback is compatible with the adjacent buildings and
complements the buildings in the immediate vicinity; and
(c) The setback provides adequate clear sight vision for vehicular
traffic.
(2) Side: None required
(3) Rear: None required
(4) The following yard requirements apply along those property lines of
a lot in the C -2 zone which abut or are across the street from a
lot in a residential zone:
(a) Front: 15 feet minimum
(b) Side abutting street: 15 feet minimum
(c) Side or rear: 20 feet minimum plus one foot for each
foot of building height over 20 feet.
A six -foot high masonry wall is re-
quired along the property line.
SECTION II.
Section 4.56.065 of the Zoning Ordinance is enacted to read:
SEC. 4.56.065 IMPROVEMENTS WITHIN YARDS ABUTTING A STREET
Improvements may be permitted in any required front yard and any re-
quired side yard abutting a street if the deciding body makes all of the
following findings:
(1) Pedestrian safety will not be impaired;
(2) The streetscape would be enhanced as a result of the proposed im-
provements;
(3) The improvements are in character with the adjacent buildings; and
(4) The improvements will not obstruct the clear sight vision of
vehicular traffic.
This section supercedes Section 3.05.010 which states that any required
yard abutting a street must be landscaped and Section 4.40.050 which
prohibits fencing in any required yard abutting a street.

SECTION III.
This ordinance takes effect 30 days after the date it is adopted. Within 15
days after this ordinance is adopted the Town Clerk shall cause it to be
published once in a newspaper of general circulation published and circulated in
the Town.
This ordinance was introduced at a regular meeting of
the Town Council of the Town of Los Gatos on November 7 1988 and adopted
by the following vote as an ordinance of the Town of Los Gatos at a regular
meeting of the Town Council on November 21 , 1988.
