Ord 1954 - Amending the Zoning Ordinance effecting a zone change from R-1:8 to R-1:8-PD for property at 16055 and 16035 Los Gatos-Almaden RoadORDINANCE 1954 ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING A ZONE CHANGE FROM R -1 :8 TO R- 1:8 -PD FOR PROPERTY AT 16055 AND 16035 LOS GATOS- ALMADEN ROAD The Town Council of the Town of Los Gatos does ordain as follows: SECTION I The Town Code of the Town of Los Gatos is hereby amended to change the zoning on properties addressed as 16055 and 16035 Los Gatos - Almaden Road shown on the map which is attached hereto marked Exhibit A and is part of this Ordinance, from R -1:8 (Single - family Residential, Minimum Lot Size 8,000 sq. ft.) to R- 1:8 -PD (Single- family Residential - Planned Development). SECTION II The PD (Planned Development Overlay) zone established by this Ordinance authorizes the following construction and use of improvements: 1. The existing single- family dwelling may remain in its present location, or be relocated on Lots 1, 2, 3, or 4 as shown on the site plan, or be removed from the project site subject to Town Codes; 2. Construction of three new single - family dwellings, or if the existing single family dwelling is removed from the project site, then of four new single family dwellings; 3. Maintain an existing pre- school facility; ATNY014 \CNCLRPTS \15055LGA.AT3 1 4. Subdivision of two lots into five lots; 5. Subdivision of the property that now contains the pre - school shall not be subdivided and no residential use shall occur on Lot 5 without a modification to this Planned Development Overlay zone; 6. Landscaping, parking and other improvements shown and required on the Official Development Plan; 7. Uses permitted are those specified in the R-1 (Single-family Residential) zone by Sections 29.60.210 (Permitted Uses) and 29.60.215 (Conditional Uses) of the Zoning Regulations of the Town Code, as those sections exist at the time of the adoption of this Ordinance, or as they may be amended in the future. However, no use listed in Section 29.60.215 is allowed unless specifically authorized by this Ordinance, or by Conditional Use Permit. SECTION III COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Chapter 29 of the Town Code, except when the Official Development Plan specifically shows otherwise. SECTION IV Architecture and Site Approval is required before the grading, demolition or construction work is performed, whether or not a permit is required for the work, and before any permit for grading, demolition and construction is issued. Grading, demolition ATNY014 \CNCLRPTS \15055LGA,AT3 2 or construction permits shall only be used in a manner complying with Section 29.80.130 of the Zoning Regulations of the Town Code. SECTION V OFFICIAL DEVELOPMENT PLAN In addition to Exhibit A (Zone Change Vicinity Map), the Site Plan, and Conceptual Elevations sheets 1 and 5 are part of the Official Development Plan. A matrix of the allowable Development Standards for each lot is attached as Exhibit B. Anything that is not listed shall fall under the rules of the underlying zone. The following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits: TO THE SATISFACTION OF THE PLANNING DIRECTOR: Planning Section 1. All conditions of approval shall be noted on the cover sheet of the Building Permit plans. 2. A Tree Removal Permit shall be obtained. 3. A tentative map shall be approved. 4. There is to be no subdivision of the property that now contains the school use without a modification to this Planned Development Overlay Zone. 5. The existing house may remain in its current location, be relocated on Lots 1, 2, 3, or 4 subject to approval and in conformance with Town Codes, or be removed from the project site subject to approval and in conformance with Town Codes. ATNY014 \CNCLRPTS \15055LGA,AT3 3 6. Six -foot high masonry walls shall be built on the adjoining property lines along the Fischer and Kipp properties prior to any construction. 7. Good neighbor fences shall be constructed along all other common property lines. 8. Prior to adoption of the official development plan, a'revised plan shall be prepared consistent with the Town Council approval. Engineering Section 9. Final grading, drainage, driveway, utility, and public improvement plans shall be submitted and approved prior to issuance of a building permit. 10. The following shall be dedicated: a. Los Gatos - Almaden Road. A 45 -foot half- street right -of -way with the chord of a 20 -foot radius return at both intersection. b. The chord standard 20 -foot radius return at the intersection. C. Ingress - egress, storm drain, sanitary sewer and public utility easement as required. 11. The following improvements shall be guaranteed by contract, Faithful Performance Security, Labor & Materialman's Security, and completed prior to the occupancy of any new building: a. Los Gatos - Almaden Road. Curb, gutter, sidewalks, street light, tie -in paving, signing and storm and sanitary sewers, as required. b. Private Street. A 24 -foot wide street, curb, gutter, parking bays, No Parking signs, street lights, storm and sanitary sewers as required. ATNY014 \CNCLRPTS \15055LGA.AT3 4 12. Insurance in the amount of one million dollars ($1,000,000) holding the Town harmless shall be provided prior to the recordation of the map. 13. Traffic impact mitigation fees for each new detached single - family home shall be paid prior to the issuance of a Certificate of Occupance. 14. A document guaranteeing maintenance of the private street by the homeowners shall be approved by the Town Attorney and recorded concurrently with the map. 15. All utilities to the new lots shall be underground. 16. Underground cable television service shall be to all new lots. 17. Sanitary sewer clean -outs shall be installed at the property line. 18. A soils and geologic report shall be prepared which provides specific criteria and standards covering site grading, drainage, pavement design, retaining wall design and erosion control. A registered civil engineer, specializing in soil mechanics, should be included in the group that prepares this report. 19. A well questionnaire (available through the Counter Technician) shall be completed. 20. All documents, contracts, security and fees, as applicable, shall be provided prior to the recordation of the map. 21. Annexation to the Town is required prior to issuance of a building permit. ATNY014 \CNCLRPTS \15055LGA,AT3 5 TO THE SATISFACTION OF THE DIRECTOR OF PARKS, FORESTRY & MAINTENANCE SERVICES: 22. Existing trees shall be inspected, pruned and put on a maintenance program by a competent tree company prior to construction. 23. Each tree planted shall be 24 in. box Town approval tree. 24. Newly planted trees shall be double- staked, using rubber tree ties and shall be planted prior to occupancy. TO THE SATISFACTION OF THE DIRECTOR OF BUILDING AND ENGINEERING SERVICES: 25. The residences shall be designed to include the following features: a. Light switches and thermostat controls shall be mounted between 36 inches and 48 inches from the floor to the center of the unit, electrical receptacle outlets shall be mounted no lower than 14 inches from floor to center of outlet. b. Wooden backing (2 ft. x 8 ft. minimum) shall be provided in all bathroom walls at water closet, shower and bathtub, located at 34 inches from the floor to the center of the backing, suitable for the addition of grab bars. C. Faucets and shower controls shall be operable with one hand and shall not require tight grasping, pinching or twisting of the wrist. The force required to activate controls shall be no greater than 5 lbs. Lever - operated, push - type and electronically controlled mechanisms are examples of acceptable designs. Separate hot and cold controls are acceptable providing they require a minimal amount of grasping to operate. ATNY014 \CNCLRPTS \l 5055LGA.AT3 6 d. All passage doors shall be at least 32- inches wide on accessible floor. e. Primary entrance shall have a 36 -inch wide door including: a 5 -foot by 5- foot level landing, 18 -inch clearance at interior strike edge, and the threshold shall be no higher than one inch with 1:3 minimum bevel (as specified in the HCD standards). Exit doors accessing the rear yard shall comply with the primary entrance criteria, except (a) the required landing adjacent to the sliding glass doors shall be flush with the bottom of the threshold of that door and that the threshold shall be no higher than one and one -half inches; (b) garage doors are totally exempt. f. Door buzzer, bell or chime shall be "hard" wired. g. At least one bathroom (lavatory sink and water closet minimum) shall be provided on the accessible floor with space requirements for accessibility (36 in. x 48 in. clear space for water closet, 30 in. x 48 in. clear space for lavatory sink). If a bathtub is installed on the accessible floor, a 30 in. x 48 in. clear space (30 inches Dimension perpendicular to tub) shall be provided. SECTION VI This Ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on July 6, 1993, and adopted by the following vote as an ordinance ATNY014 \CNCLRPTS \15055LGA.AT3 7 of the Town of Los Gatos at a meeting of the Town Council of the Town of Los Gatos on August 2, 1993. This ordinance takes effect 30 days after it is adopted.
