RESOLUTION OF'THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ADOPTING FEES FOR DEVELOPMENT APPLICATIONS THAT ARE REFERRED BACK
TO THE PLANNING COMMISSION BY THE TOWN COUNCIL AND ESTABLISHING
APPEAL :FEES FOR APPEALS OF DIRECTOR OF COMMUNITY DEVELOPMENT AND
DEVELOPMENT REVIEW COMMITTEE DECISIONS.
WHEREAS, the Town has had an increase in the number of applications being appealed;
and
WHEREAS, a number of applications are being appealed to the Town Council and are
subsequently referred back to the Planning Commission .for redesign; and
WHEREAS, applications that are referred back to the Planning Commission and those that
are appealed result in additional processing time and noticing costs; and
WHEREAS, development projects going through the process more than once are resulting
in costs not being recovered while Town's goal is full cost recovery for processing of development
applications; and
THEREFORE, BE IT RESOLVED: The Town Council hereby amends the Town :Fee
Schedule to establish the following fees: (a) A fee of 50% of the original planning application fee
for processing. applications that are referred from the Town Council to the Planning Commission,
except whenthe Town Council determines that the Planning Commission erred in its decision; and
(b) A fee of $50 for appealing a decision of the Director of Community Development or
Development Review Committee (DRC).
FURTHER RESOLVED:.'The Town Council shall have the authority to waive the 50%
remand fee if it determines this to be an appropriate action.
FURTHER RESOLVED: This resolution shall take effect 60 days from the date of
adoption.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los
Gatos, California, held on thel.6 nth day ofJANUARY, :2,001.- by the following vote.:
