<br />RESOLUTION 2001-1 <br />RESOLUTION OF'THE TOWN COUNCIL OF THE TOWN OF LOS GATOS <br />ADOPTING FEES FOR DEVELOPMENT APPLICATIONS THAT ARE REFERRED BACK <br />TO THE PLANNING COMMISSION BY THE TOWN COUNCIL AND ESTABLISHING <br />APPEAL :FEES FOR APPEALS OF DIRECTOR OF COMMUNITY DEVELOPMENT AND <br />DEVELOPMENT REVIEW COMMITTEE DECISIONS. <br />WHEREAS, the Town has had an increase in the number of applications being appealed; <br />and <br />WHEREAS, a number of applications are being appealed to the Town Council and are <br />subsequently referred back to the Planning Commission .for redesign; and <br />WHEREAS, applications that are referred back to the Planning Commission and those that <br />are appealed result in additional processing time and noticing costs; and <br />WHEREAS, development projects going through the process more than once are resulting <br />in costs not being recovered while Town's goal is full cost recovery for processing of development <br />applications; and <br />THEREFORE, BE IT RESOLVED: The Town Council hereby amends the Town :Fee <br />Schedule to establish the following fees: (a) A fee of 50% of the original planning application fee <br />for processing. applications that are referred from the Town Council to the Planning Commission, <br />except whenthe Town Council determines that the Planning Commission erred in its decision; and <br />(b) A fee of $50 for appealing a decision of the Director of Community Development or <br />Development Review Committee (DRC). <br />
