Ord 0533-44 EASTWOOD PARK NO. ONE ANNEXATIONtt ORDINANCE NO. _zg~L,3 AN ORDINANCE APPROVING THE AiNNEKATION OF CERTAIN UNINHABITED TERRITORY, DESIGNATED 44 EASTWOOD PARK MBER ONE ANNEXATION" TO THE TOWN OF LOS GATOS. THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS F0LL0'V'VS : WHEREAS on the 7th day of March 19 60, the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to_annex certain uninhabited territory to the -.Town of Los Gatos, said territory being therein designated as "Eastwood Park Number One Annexation's , and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did contain a notice of the day, hour and place when and where the said Council of said Town would hear protests made by any person owning real property with- in the territory proposed to be annexed, the time of said hearing being not 'Less than twenty nor more than sixty days from the date of the passage of said Resolution; and WHEREAS, on the 18th day of April... 19 60, at the hour of 8:00 o'clock p.m. in the Los Gatos Council Chambers in the Town Hall of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the day, hour and place fixed in said Resolution for hearing protests to said annexation, the said Council of said Town did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shown by the equalized roll, nor by public and private owners of equal to one-half of Page_ of Pages T the value of the territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the Town of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1939, particularly Government Code Sections 35300 and 35314 inclusive have been fully complies: with; NONT, THEREFORE., the said Council of the Town of Los Gatos does hereby aVprove the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain r that the said territory be and is hereby annexed to the Town of Las Gatos. That said territo.-y, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as follows: Page of Pages :VCPij4F BEGINNING on a y-line of the Town Limits, Town of Los Gatos, at the point of intersection with the the southerly line of that certain parcel of Deed from James A. Franklin and N. Gwendolyn Franklin and N. Gwendolyn Franklin, as joint 20, 1955, recorded October 27, 1955, in Book Page 372, Santa Clara County Records; easterly prolongation of land as conveyed in the Franklin to James A. tenants dated October 3316 Official Records, THENCE, along said easterly prolongation and along said south- erly line of the aforementioned Franklin parcel westerly to the southwesterly corner thereof ; THENCE, further westerly along the westerly prolongation of the last mentioned course to the point of intersection with the center line of the San Tomas Aquino Road ( Presently Santa Clara-Los Gatos Road) as the same existed prior to June 30, 1954; TBEIN'CE, southerly along the center line of the said San Tainas Aquino Road, as said center line existed prior to June 30, 1954, to the point of intersection with the westerly prolongation of the westerly course of the southerly line of Vineland Avenue, as shown upon that certain map entitled "Eastwood Park", which map was filed for record in the office of the Recorder of the County of Santa.'; Clar•.a, State of California, on April 21, 1925, in Book 5 of Daps, Page 45; THENCE, easterly along the aforementioned westerly prolongation of said southerly line of said Vineland Avenue and along the various courses and distances of said southerly line of said Vineland Avenue to the point of intersection with the westerly line of that certain parcel of land as conveyed to Ray H. Burgess, et al by Deed recorded in Book 1363, Official Records, Page 561, Santa Clara County Records; THENCE, following the exterior boundaries of said last named parcel conveyed to Burgess southerly and easterly to the point of intersection with the westerly line of that certain parcel of land as conveyed to Ray H.
