Ord 0492-WEDGEWOOD NUMBER TWO ANNEXATIONd ORDINANCE NO._ AN OaDINANCE APPROVING THE ANNEXATION OF CERTAI"'a UNINHABITED TE_R.izITORY, DESIGNATED "WEDGE, OOD NUMBER TWO ANN&KATION" TO THE TOIAR,7 Or LOS GATOS. THE TO11J1'.J COUNCIL OF THE TOlVPIT OF LOS GATOS DOES ORDAIN AS TOLLOWS: WHEREAS, on the 2nd day of February, 1959, the Council of the Town of Los Gatos did pass and adopt a Resolution giving notice of the proposal to annex certain uninhabited territory to the Town of Los Gatos, said territory being therein designated as "Wedgewood Number Two Annexation", and said action being taken by the Council of said Town as the legislative body of the Town pursuant to a written petition therefore, said Resolution describing the boundaries of the territory so proposed to be annexed to said Town; and WHEREAS, said Resolution did.contain. a notice of the day, hour and place when and where the said Council of said Town would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said hearing being not less than twenty nor more than sixty days from the date of the passage of said Resolution; and WHEREAS, on the 16th day of 'arch, 1959, at the hour of 8:00 o'clock p.m. in the Los Gatos Town `Council Chambers in the Town Mall of the Town of Los Gatos, County of Santa Clara, State of California, said time and place being the day, hour and place fixed in said Resolution for hearing protests to said annexation, the said Council of said Town did hear and pass upon all protests made to said proposed annexation and did determine that no protests to said proposed annexation have been made by or on behalf of the owners of one-half of the value of the territory proposed to be annexed as shoran by the last equalized roll, nor by public and r~ 3 .I.^.5 Page of Pages private owners of equal to one-half of the value of the territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the 'T'own of Los Gatos, and is uninhabited territory in the County of Santa Clara, and all of the procedural requirements of the annexation of Uninhabited Territory Act of 1939, particularly Government Code sections 35300 to 35314 inclusive have been fully complied with; T NOW, THEREFORE, the said Council of the Town of Los Gatos does hereby approve the annexation of said territory, hereinafter described, to the Town of Los Gatos and does hereby further ordain that the said territory be and is.hereby annexed to the Town of Los Gatos. That said territory, the annexation of which to the Town of Los Gatos is hereby approved, is all that territory situate in the County of Santa Clara, State of California, more particularly described as follows: 'Wage of Pages n Beginning on the northwesterly line of the Town Limits, Town of Los Gatos, at the paint of intersection with the easterly prolongation of the northerly line of that certain parcel of land as described in the Indenture between Elizabeth Mundhenke, party of the first part, and rl~zabeth M. Bisque,- party of the second part, dated August j, 1916, recorded October 24, 1922, in Book 564 of heeds, Page 167, Santa. Clara County Records; thence westerly along said easterly prolongation of said northerly line of said east named parcel, and continuing westerly along said northerly line of said last named parcel to the northwesterly corner of said lest named parcel being a point in the Town Limits line of the Town of Los Gatos; thence. following the Town Limits_li-,ne of the Town of Los Gatos north- easterly, westerly, northeasterly and easterly to the south- westerly corner of that certain parcel of land as described in the ~0' int Ter?aney.D.eedfrlnmStanley B. Smith and Isabel R. Smith, Joint Tenants, and Albert B. Smith to S. J. Leider and Esther Leider, dated January i2, 1,048, recorded January 23, 1948, in Book 1457 Official Records, Page 166, Santa Clara County Records; thence following the exterior boundaries of said last named parcel and the Town Limits line of the Town of Los Gatos,easterly and northerly to the point of intersection with the southerly line of Wedgewood Avenue, as the same now exists; thence easterly along said southerly line of Wedgewood avenue, as the same now exists, to the point of Intersection with the southwesterly line of Pollard Road and the Town Limits line of the Town of Los Gatos; thence following the Town Limits line of the Town of Los Gatos southeasterly and easterly to a-point on the easterly right-of-- way line of the Souther. Pacific Railroad Company; thence follo?,,T- ing the easterly line of the Southern Pacific Railroad Company right-of -wa.y.and the Town Limits line of the Town of Los Gatos southwesterly to the point of beginning, Introduced at a regular meeting of the Town.
