Ord 0299- REGULATING THE PRESENCE OF MINORS UNDER THE AGE OF 18 YEARS IN PUBLIC STREETS AND OTHER PLACES BETWEEN CERTAIN HOURS, DEFINING DUTIES OF PARENTS OR OTHERS IN CARE OF MINORS, PROVIDING FOR ARREST AND PENALTIES FOR VIOLATIONS THEREOFORDINANCE NO. q 9 AN ORDINANCE REGULATING THE PRESENCE OF MINORS UNDER THE AGE OF 18 YEARS IN PUBLIC STREETS AND OTHER PLACES BETWEEN CERTAIN HOURS, DEFINING DUTIES OF PARENTS OR OTHERS IN CARE OF MINORS, PROVIDING FOR ARREST AND PENALTIES FOR VIOLATIONS THEREOF, REPEALING ORDI- NANCES IN CONFLICT THEREWITH. THE TONTN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS : Section I. LOITERING OF MINORS PROHIBITED. It shall be unlawful for any minor under the age of 18 years to loiter, idle, dander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, or,other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots, or other unsupervised places in the Town, of Los Gatos, between the hours of 11 o'clock P. M. and daylight of the follow- ing day; provided, however, that the provisions of this Section do not apply when the minor is accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor. Each violation of the provisions of this Section shall constitute a separate offense. Section 2. RESPONSIBILITY OF PARENTS. It shall be unlawful for the parent, guardian, or other adult person having the care and custody of a minor under the age of 18 years to permit such minor to loiter, idle, wander, stroll, or play in or upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement and entertainment, vacant lots or other unsupervised places in the Town of Los Gatos between -1- the hours of 11 o'clock P. M. and daylight of the following day; provided, however, that the provisions of this Section do not apply when the minor is accompanied by his or her parent, guar- dian, or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legi- timate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor. Each violation of the provisions of this Section shall constitute a separate offense. Section 3. INVESTIGATION BY OFFICERS. Whenever any police or other officer charged with the duty of enforcing the lags of the State of California, or ordinances of the 'own of Los Gatos, discovers or has his attention called to the fact that any such minor is upon the public streets, highways, roads, alleys, parks, playgrounds, or other public grounds, public places and public buildings, places of amusement and entertain- ment, vacant lots, or other unsupervised places in the Town of Los Gatos, between the hours of 11 o'clock P.-M. and daylight of the following day, and that such minor is not accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or where the minor is not upon an emergency errand or legitimate business directed by his or her parent, guardian, or other adult person having the care and custody of the minor, said officer small make an immediate inves- tigation for the purpose of ascertaining whether or not the pres- enee of said minor upon or in any of the places hereinabove desig- nated, is not prohibited by the provisions of this Ordinance. If the investigation reveals that the presence of said minor upon or in any of the places hereinabove designated is prohi- bited-by the provisions of this Ordinaance, then said officer shall cause said minor to be taken to his or her home, -2- or place of residence, and said minor and any person or persons having violated the provisions of this Ordinance, shall be sum- moned to appear before the Police Judge of the Town of Los Gatos, to be dealt with in accordance with the provisions of this Ordinance. Section 4. PENALTIES. Any minor violating the provi- sions of Section 1 shall be dealt with in accordance with the Juvenile Court Law and Procedure. Any parent, guardian, or other adult person having the care, and'custody of a minor violating Section 2 shall be fined, not less than $_/0 , not, more than _oo or confined in jail not more than 3t) days, or pun-41 ished by both said fine and imprisonment for each offense. Section 5. REPEAL OF CONFLICTING ORDINANCES. All exist- ing ordinances of the Town of Los Gatos are hereby repealed inso- far as they may be inconsistent with the provisions of this Ordinance. Section 6. SEPARABILITY OF PROVISIONS. It is the inten- tion of the Town Council of the Town of Los Gatos that each separate provision of this Ordinance shall be deemed independent of all other provisions herein, and it is further the intention of the Town Council of the Town of Los Gatos that if any provi- sion of this Ordinance be declared invalid, all other provisions thereof shall remain valid and enforceable. Section 7. This ordinance shall be published once in - a newspaper of general circulation, printed and published in the Town of Los Gatos.
