RESOLUTION DENYING APPEAL FROM THE PLANNING
COMMISSION DENIAL OF CONDITIONAL USE PERMIT
APPLICATION AND ARCHITECTURE AND SITE
APPLICATION REQUESTING APPROVAL OF PLANS TO
CONSTRUCT AND OPERATE A GOLF DRIVING RANGE
(14739 South Bascom Avenue at Wanda Lane- -Los Gatos Driving Range)
WHEREAS:
1. Dennis Nino appealed a decision of the Planning Commission
as follows: denial of Conditional Use Application U -85 -28 and
Architecture and Site Application S -85 -65 requesting approval
of plans to construct and operate a golf driving range on
property located in R- 1:8000 zone at 14739 South Bascom Avenue
at Wanda Lane;
2. A public hearing was held by the Town Council on January 21, 1986;
IT IS HEREBY RESOLVED:
1. The Town Council hereby finds that no testimony or evidence
was presented that the Planning Commission decision was in error.
2. The Town Council further finds that the Planning Commission
decision was correct to deny the conditional use permit application
and the architecture and site application requesting approval of
plans to construct and operate a golf driving range.
3. Based on the foregoing findings, the appeal is denied.
Pursuant to the Los Gatos Town Code Section 1 -15, the time for
seeking judicial review for the Town Council decision is governed
by California Code of Civil Procedure Section 1094.6.
PASSED AND ADOPTED at a reqular meeting of the Town Council of
the Town of Los Gatos held on the 3rd day of February 1 1986
by the following vote:
