ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK OF
CASEY CONSTRUCTION, INC. AND AUTHORIZE RECORDING BY THE CLERK
ADMINISTRATOR FOR PPW JOB NO. 15-816-0412 FRANK AVENUE STORM
DRAIN IMPROVEMENT PROJECT.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
(Attachment 1) accepting the work of Casey Construction, Inc. and authorize recording by the Clerk
Administrator for PPW Job No. 15-816-0412 Frank Avenue Storm Drain Improvement Project.
BACKGROUND:
The Town's adopted five year Capital Improvement Program (CIP) Budget designates funding for the
Frank Avenue Storm Drain Improvement project. This project entailed installing a new storm drain
pipeline, including installation of a catch basin and manhole, on Frank Avenue between Augustine
Avenue and Izorah Way to address flooding issues.
On August 18, 2015, the Town Council approved the plans and specifications for the Frank Avenue
Storm Drain Improvement Project and authorized the Town Manager to award a construction agreement
in an amount not to exceed the available construction budget of $157,440, including contingencies and
any change orders, to the low bidder. As provided to Council in a previous Manager's update, the low
bidder for the project was Casey Construction. The Town entered into an agreement with Casey
Construction for this work for the low bid amount of $81,820.

The work has been satisfactorily completed by Casey Construction for this project and staff recommends
project acceptance.
Five percent of the faithful performance bond will remain in effect for a period of two years as guarantee
for any needed repair or replacement caused by defective materials and workmanship. The execution
and recordation of the Certificate of Acceptance and Notice of Completion is required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Casey Construction, Inc. and authorize
recording by the Clerk Administrator for PPW Job No. 15-816-0412 Frank Avenue Storm Drain
Improvement Project.

ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15303d). A Notice of
Exemption was filed.
FISCAL IMPACT:
The final project cost was $101,840, of which $81,873 was direct construction costs, all within the
project budget, as demonstrated in the fiscal table below. The remaining unexpended funds will remain
within the Storm Basin Two fund for future stormwater projects.

TO WHOM IT MAY CONCERN:
I do hereby certify that Casey Construction, Inc. completed the work called for in the
agreement with the Town of Los Gatos dated November 5, 2015. The work is outlined in the
Town's bid process prepared by the Town of Los Gatos and generally consisted of furnishing all
labor, materials, tools, equipment, and services required for completion of the PPW Job No. 15-
816-0412 Frank Ave. Storm Drain Improvement Project located in the TOWN OF LOS GATOS,
County of Santa Clara, State of California and was completed, approved and accepted February
2, 2016.
